Description:
Full line WSG laboratory (genome sequencing) and related consumables

The contracting authority aims to purchase a complete WSG laboratory (genome sequencing) and related consumables, by applying an open tender procedure with which a 2-month supply contract will be concluded with the successful bidder. The contracting authority shall reply clearly and completely to all requests for clarifications on the 11th day before the deadline set for submission of tenders, insofar as they are submitted within the specified deadline. Number of days until which clarifications may be requested before the closing date for submission of tenders/applications: 18 days.

The procedure for awarding the public procurement contract is initiated under this suspensive clause, meaning that the conclusion of the public procurement contract is conditioned by the allocation of budget appropriations for this purpose, in case of extension of the project "Strengthening tuberculosis control in Romania through the implementation of the WHO END TB Strategy 2016 – 2020", Contract no. 1698/29.04.2020 financed by the Ministry of Health, based on the EEA Financial Mechanism 2014 – 2021, the signing of the contract being made in compliance with the provisions regarding the commitment of expenses from the budgets covered by the legislation on public finances.

Having regard to the provisions of Law 98/2016 on public procurement and H.G. no. 395/2016, as subsequently amended and supplemented, the Contracting Authority specifies that it will conclude the contract with the successful bidder only to the extent that the funds necessary for the procurement will be ensured by allocating budget appropriations for this purpose. If, for whatever reasons, budget appropriations will not be allocated, for a period of 3 months from the date of approval of the report of the award procedure, the award procedure shall be cancelled de jure, provided that there is no other source of financing, in accordance with the provisions of Article 212 para. (1) letter c) of Law 98/2016 with subsequent amendments and completions, being impossible to conclude the public procurement contract. Tenderers in this procedure understand that the Contracting Authority cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority has been notified of the existence of such damage.

Bidders in this procedure accept the use of the above special conditions/standstill clause, assuming full responsibility for any damage they may suffer in the situation described. The maximum period for which the standstill clause operates is 3 months, so that if the condition of signing the financing contract is not met, the award procedure is cancelled."

NEXT-GENERATION SEQUENCING SYSTEM

The contracting authority has grouped within the same batch products that have the same purpose - functionality and diagnostic flow. Thus, batch 1 includes laboratory equipment integrated into a genomic sequencing line and consumables/reagents for carrying out work in a molecular biology laboratory.

Given the complexity of creating a genome sequencing laboratory for Mycobacterium tuberculosis and the need to integrate equipment into the workflow, it is necessary to include products in the same batch, thus ensuring the functionality and operability of the laboratory.

The establishment of a genomic sequencing laboratory requires adequate space, appropriate equipment and qualified personnel, as one of the most important points to consider is the design and equipment of the laboratory so as to ensure a correct flow of samples in the laboratory, prevent cross-contamination of samples, ensure the necessary level of biosafety and reliable results

RELATED LABORATORY EQUIPMENT

The contracting authority has grouped within the same batch products that have the same purpose - functionality and diagnostic flow. Thus, batch 2 includes laboratory equipment related to the genomic sequencing line.
