Deliveries covered by Executive Orders for ENEA Nowa Energia sp. z o.o. will be implemented in the provinces: Greater Poland, West Pomerania, Lubusz, and Kuyavian-Pomeranian. Regarding ENEA Ciepło sp. z o.o., the procedure covers one project, for which delivery is anticipated at the location of Białystok (Podlaskie Voivodeship).

Due to the dynamics of the investment process, the Contracting Authority reserves the right to change specific locations, especially in the case of replacing a given project with another. Possible new locations are anticipated within the above-mentioned provinces.
1. The Contracting Authority plans to implement the delivery of BESS systems with a total target capacity of 840 MWh usable capacity, in various power/capacity configurations, in accordance with Appendix no. 1a to the OPZ.
2. The Contracting Authority guarantees placing orders and purchasing a total of at least 600 MWh usable capacity within 24 months from the date of the contract conclusion, in configurations arising from the needs of the Contracting Authority and Appendix no. 1a to the OPZ.
3. The Contracting Authority anticipates the possibility to exercise the option right in accordance with art. 441 uPZP increasing the scope of the order by 240 MWh to the planned level of 840 MWh. The detailed way of exercising the option right is described in the contract documentation.
4. The Contracting Authority allows the possibility of providing the Contractor with advances for the execution of the subject of the contract, in accordance with art. 442 sec. 1 uPZP. The total value of the advances will not exceed 100% of the gross contractual remuneration. The detailed way of providing advances is described in the contract documentation.
