Description:
Procurement of various equipment to enhance cybersecurity and information protection for the City Hall of Sosnowiec, including manageable network devices, an uninterruptible power supply, and a backup system.

STATEMENTS AND DOCUMENTS SUBMITTED WITH THE OFFER: 1.1. The offer must be submitted electronically (i.e. marked with a qualified electronic signature) under pain of nullity. The offer should be prepared according to the template constituting – Annex No. 1 to the SWZ.
1.2. The Contractor shall attach to the offer a statement of non-exclusion (concerning parts 1-3) – and compliance with the conditions for participation in the procedure concerning (part 3) specified in Chapter III, section 1 of the SWZ: in the scope indicated in Chapter III, section 2 of the SWZ:
a) pkt. 2.2. SWZ [regarding the grounds for exclusion under Article 108(1)(1) – (6) of the Pzp Act] – the statement should be submitted in the form of a Single European Procurement Document [hereinafter: “JEDZ”] – Annex No. 3 to the SWZ;
b) pkt 2.3. SWZ [regarding the grounds for exclusion under Article 7(1) of the Act of April 13, 2022, on special solutions for counteracting support for aggression against Ukraine and for ensuring national security] – the statement should be submitted in the form of JEDZ, marking the appropriate answer in Section III, Section D – Annex No. 3 to the SWZ;
c) pkt. 2.4. SWZ [regarding the grounds for exclusion under Article 5k) of Council Regulation (EU) No. 833/2014 of July 31, 2014, as amended by Regulation 2025/2033 (Journal of Laws L, 2025/2033, 23.10.2025)] – the statement needs to be submitted according to the template indicated in Annex No. 4 to the SWZ.
These statements serve as proof confirming the absence of grounds for exclusion and compliance with the conditions for participation in the procedure as of the submission date of offers, temporarily replacing the required subjective means of evidence indicated in Chapter IV, section 2, item 2.1. SWZ.
1.3. The statement referred to in Chapter IV, section 1, item 1.2. SWZ letters a) – b) must be submitted in the form of a single European procurement document, prepared according to the standard form specified in the delegated regulation of the European Commission issued under Article 59(2) of Directive 2014/24/EU, hereinafter referred to as the “Single Document”. The Contractor is obliged to submit the Single Document in the scope indicated in Annex No. 3 to the SWZ. The contracting authority informs that there is an Instruction for filling in the Single Document on the website of the Public Procurement Office.
1.4. The model of the Single Document submitted by the Contracting Authority conforms to the Delegated Regulation (EU) 2016/7 of January 5, 2016, establishing the standard form of the single European procurement document. The Contractor is obliged to fill in the Single Document to the extent that the Contracting Authority can verify whether the Contractor meets the conditions for participation in the procedure and is not excluded in the scope described in this SWZ.
1.5. Statements referred to in Chapter IV, section 1, item 1.2. SWZ are submitted separately:
1) Contractor/every one of the Contractors jointly applying for the award of a contract. In this case, the statement confirms the absence of grounds for exclusion for the Contractor and the fulfillment of the conditions for participation in the procedure regarding each Contractor's compliance with the conditions for participation in the procedure;
2) the entity providing resources, on which the Contractor relies to confirm compliance with the conditions for participation in the procedure. In this case, the statement confirms the absence of grounds for exclusion for the entity and compliance with the conditions for participation in the procedure in the scope in which the entity makes its resources available to the Contractor.
1.6. The Contractor is obliged to attach to the offer:
1) statements referred to in Chapter IV, section 1:
item 1.2. a) – b) SWZ – in the form of JEDZ (according to Annex No. 3 to the SWZ), and
item 1.2. c) SWZ – using the template attached to the SWZ;
2) a copy or information from the National Court Register, the Central Register and Information on Economic Activity or another relevant register confirming that the person acting on behalf of the contractor is authorized to represent him;
3) the power of attorney or other document confirming the authorization to represent the Contractor, if the authorization of the person submitting the offer does not arise from the documents described in item 2);
4) an obligation referred to in Chapter I, section 5, items 5.3 and 5.4 SWZ in case of relying on the resources of the entity providing the Contractor's resource;
5) in the case of contractors jointly applying for the award of a contract:
a) a power of attorney, the content of which indicates the authorization to represent them in the procedure for awarding the contract or to represent them in the procedure and conclude a contract regarding the public procurement. The power of attorney should particularly include identification of:
- the public procurement procedure concerned,
- all contractors jointly applying for the award of the contract named with addresses,
- the appointed attorney and the scope of his authority;
b) a statement referred to in Chapter I, section 4, item 4.4 SWZ (The contracting authority allows the submission of this statement on the offer form).
1.7. The Contractor is not obliged to submit the documents mentioned in item 1.6, item 2), provided that the Contracting Authority can obtain them through free and publicly available databases, as long as the Contractor provided data allowing access to those documents.
1.8. The provisions of item 1.6, item 3) apply accordingly to the person acting on behalf of the contractors jointly applying for the award of the contract.
1.9. Provisions of item 1.6, item 3) and item 4), item 1.7 apply accordingly to the person acting on behalf of the entity providing resources under the principles specified in Article 118 of the Pzp Act.
