Additional information regarding the proceedings: The contracting authority will seek to obtain funding for the purchase of the subject of the order from the Cohesion Fund under the European Funds for Infrastructure, Climate, Environment 2021-2027, Priority FENX.03 Urban Transport, Action FENX.03.01, proceeding: FENX.03.01-IP.02-001/26. Information regarding equivalent solutions: 1. The contracting authority, in describing the subject of the order by indicating trademarks, patents, or origin, source, or a particular process that characterizes products or services supplied by a specific contractor, allows equivalent solutions to those described, taking into account the provisions below: The contracting authority has made efforts to describe the subject of the order in a clear and comprehensive manner, using sufficiently precise and understandable definitions, taking into account all requirements and circumstances that may affect the preparation of the offer. However, wherever trademarks, patents, or origin, sources, or a particular process characterizing products or services supplied by a specific contractor are indicated in the SWZ, it means that the contracting authority could not describe the subject of the order in a sufficiently precise and understandable way, and such indication means the possibility of applying a solution or product that is equivalent so as not to privilege or eliminate certain contractors or products. The required equivalence features specify in each case the boundary parameters and functional requirements indicated for a given element of the subject of the order. 2. The contracting authority, when describing the subject of the order using standards, technical assessments, technical specifications, and systems of technical references, allows equivalent solutions to those described, taking into account the provisions below: Wherever in the SWZ specific standards or regulations are referenced, which materials and devices must meet, the provisions of the latest edition or amended edition of the referenced standards and regulations will apply. If the referenced standards and regulations are state standards or refer to a specific country or region, other relevant standards providing fundamentally equal or higher performance than the referenced standards or regulations may also be applied, provided they are previously verified and approved in writing by the contracting authority. 3. Whenever the description of the subject of the order refers to standards, technical assessments, technical specifications, technical reference systems mentioned in Article 101(1)(2) and (3) of the Public Procurement Act, the contracting authority allows equivalent solutions provided that the contractor proves in the offer, in particular using the evidence referred to in Articles 104-107 of the Public Procurement Act, that the proposed solutions meet the requirements specified in the description of the subject of the order to an equivalent extent. The contracting authority recognizes a solution as equivalent that allows achieving the expected effect described in the subject of the order using different technical solutions or parameters not worse than those required and described in the SWZ. Information regarding contractors jointly applying for orders: 1. Contractors may jointly apply for the award of the order. In this case, the contractors appoint an attorney to represent them in the proceedings or to represent them in the proceedings and conclude an agreement regarding the public procurement. 2. The contracting authority does not require contractors mentioned above to have a specific legal form in order to submit an offer. 3. If the offer of contractors jointly applying for the award of the order is selected, the contracting authority requires, before concluding the agreement regarding public procurement, a copy of the agreement regulating the cooperation of these contractors. Information regarding the reservation of business secrets: 1. Together with the submission of information constituting a business secret within the meaning of the provisions of the Act of April 16, 1993, on combating unfair competition, the contractor is obliged to indicate in the offer that they cannot be made available and demonstrate that the reserved information constitutes a business secret. 2. Documents containing information constituting a business secret should be attached in a separate file with simultaneous marking of the instruction "The document contains a business secret". The upload of the attachment is done through the instruction "Drag here or Select a file from disk". Information about documents containing values in foreign currencies: If the contractor attaches to the offer or submits in the proceedings documents containing values in a currency other than the Polish zloty (PLN), the contracting authority will convert these values into Polish zlotys (PLN) according to the average exchange rate of the National Bank of Poland (NBP) of that currency on the day of announcement of this procedure. If the NBP does not publish the average exchange rate table on that day, the contracting authority will accept as the basis the first rate from the average exchange rate table announced after the announcement of this procedure.

Delivery of one brand new low-floor electric bus of the MAXI class with an option to purchase a maximum of 15 additional buses with the same parameters.
1. The subject of the order is the delivery of one brand new low-floor electric bus of the MAXI class with the option to purchase a maximum of 15 additional buses with the same parameters and a battery package with BMS (package identical to the energy storage used in the offered buses). 2. The buses mentioned in point 1 must meet the technical requirements specified in Appendix No. 3 to the SWZ (description of the subject of the order). 3. The offered buses must be brand new, produced no earlier than the year of delivery, unexploited, and not used for testing, trials, presentations, or similar purposes. It is permissible to perform short post-production test drives to verify the correctness of assembly and eliminate defects. 4. General requirements for buses: buses adapted for transporting people with disabilities, equipped, among others, with a digital video monitoring system of the passenger compartment and driver's cabin, a ticket vending machine, air conditioning, and a fire detection and extinguishing system for the aggregate compartment. 5. All supplied buses must be: of one brand, identical in design, composition, and equipment. 6. The scope of delivery includes 1 bus, and in case of exercising the option right, a maximum of 16 buses (including a maximum of 15 covered by the option and a battery package with BMS (package identical to the energy storage used in the offered buses)) with additional equipment and documentation and necessary software on the terms specified in the SWZ, including in the draft agreement constituting Appendix No. 2 to the SWZ. 7. The contracting authority requires the delivered buses to be fully compatible with the charging infrastructure (including Plug-In chargers and pantograph chargers) that it has (the description of compatibility conditions is included in the Description of the Subject of the Order). 8. The contracting authority requires that the share of products originating from member states of the European Union, countries with which the European Union has entered agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU apply by virtue of a Council decision, exceeds 50% of the total value of the products included in the offer. The contracting authority requires a declaration in this regard to be submitted in the offer form (Appendix No. 6 to the SWZ). In accordance with Article 393(1)(4) of the Public Procurement Act, the contracting authority will reject an offer in which the share of products originating from EU member states, countries with which the EU has entered into agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU apply does not exceed 50% of the total value of the products included in the offer. 9. The contractor is obliged to ensure the security of the supply chain mentioned in Article 3e of the Regulation of the European Parliament and of the Council (EU) 2024/1610 of May 14, 2024, amending Regulation (EU) 2019/1242 and to ensure ongoing and estimated availability of necessary spare parts ensuring the operation of the offered buses being the subject of the offer for a minimum period of 15 years from the date of delivery. 10. The deadline for completion of the order: The deadline for the execution of the subject of the order is established as follows: 1) for one low-floor electric bus of the MAXI class (basic scope) within 16 months from the date of conclusion of the agreement, but no later than by October 31, 2027, 2) for an additional maximum of 15 low-floor electric buses of the MAXI class and a battery package with BMS (optional scope) within 18 months from the date of submission of the declaration of exercising the option right (the deadline for submitting the declaration is 12 months from the date of conclusion of the agreement) - under the option right, the contracting authority may order from 1 bus up to a maximum of 15 buses, with the reservation that the contracting authority may exercise the option right multiple times until the maximum number of 15 buses is exhausted). The order of the battery package with BMS constitutes a separate (independent of the aforementioned additional buses) option right. 11. Calculation of the total score of the offer: P = PC + PT where: P – total number of points awarded to the offer PC – number of points obtained dependent on the offered gross price PT – number of points obtained depending on the offered technical and operational conditions
