Electric Energy Storage (EES) with a minimum power of 39 MW The subject of the contract is the implementation of all necessary activities in the "design and build" formula in the scope of designing, agreeing, and performing all works, including construction and assembly, electrical, telecommunications, sanitary, and deliveries necessary for the proper execution and functioning of the Electric Energy Storage with a power of not less than 39 MW and capacity of not less than 165 MWh (hereinafter: "EES") along with MV/LV connections and necessary accompanying infrastructure, for the purpose of power output to the grid of the relevant Distribution System Operator (DSO) in accordance with the Connection Conditions and requirements of the Distribution System Operator (DSO), as well as obtaining all required permits necessary for the proper use of the EES by the Contracting Authority and providing warranty and service services during the warranty period.

Due to restrictions of the Competitiveness Base related to the inability to add the correct operational program, the Contracting Authority informs that the procedure added in BK is only a technical solution. The project is implemented under priority program no. 1.15 "Energy transition Electric energy storages and related infrastructure for improving the stability of the Polish power grid." This program is implemented by the National Fund for Environmental Protection and Water Management (NFOŚiGW) and financed from the Modernization Fund.
UPDATE 29.09.2026 The Contracting Authority has made changes in: • The Request for Proposal item XI.5 from "* guaranteed RTE efficiency will be calculated separately for each part of the EES according to the connection point at stations S-41 and S-42" to "* guaranteed RTE efficiency will be calculated separately for each part of the EES according to the connection point at stations S-41 and S-42, excluding energy consumption for general facility own needs of the EES. The AC-AC RTE measurement should refer to the standard ambient temperature of 25°C"; • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor – in Table 1. Offered storage units in item 1 from "Usable capacity" to "Nominal capacity"; • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor – in Table 3. Offered low-voltage/MV power transformers in item 1 from "Transformer power: up to 4.5 MVA" to "Transformer power: up to 4.5 MVA or greater provided other requirements specified in the Request for Proposal documents are met and showing that using a higher power transformer will not negatively affect parameters and installation safety"; • Attachment No. 2 – Functional and Utility Program – according to item XIV.3 of the Request for Proposal, the list of changes has been published on the server containing documentation constituting a business secret and is available to Bidders who have submitted a signed Confidentiality Statement. As a result, the Contracting Authority extended the deadline for submitting offers to 28.10.2026.
UPDATE 05.10.2026 The Contracting Authority has made changes in: • The Request for Proposal item VII.3 from "Planned contract signing date: 10/2026" to "Planned contract signing date: 11/2026"; • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor in the document designation from "Attachment No. 1 to Request for Proposal No. 1/2026" to "Attachment No. 1A to Request for Proposal No. 1/2026"; • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor in Table 2. Offered bidirectional PCS converters in item 1 from "Maximum rated inverter power: 150 kW" to "Maximum available power loss due to failure of a single inverter or its module, along with protection system operation consequences: 1100 kW", in item 2 from "Maximum distortion factor THD: 1.5%" to "Maximum distortion factor THD at rated power, for charging and discharging: 8%" and adding item 3 "Maximum distortion factor THD of current measured on the 6 kV side at each EES track connection point to switchboards S-41 and S-42, in each phase at the rated power of the given track, for charging and discharging (using appropriate filtering systems): 3%", simultaneously updating the numbering of subsequent rows in the table; • Attachment No. 2 – Functional and Utility Program – according to item XIV.3 of the Request for Proposal, the list of changes has been published on the server containing documentation constituting a business secret and is available to Bidders who have submitted a signed Confidentiality Statement; • Attachment No. 6 – Contract Template with the Contractor in §7 ADVANCES AND PARTIAL PAYMENTS adding paragraph 3: "Detailed rules and conditions of advance payments are specified in Attachment No. 14 to the Contract, taking into account the following requirements: a) advance payment is a one-time payment and may be made up to a maximum of 20% of the Contract Price; b) advance payment can be used by the Contractor exclusively for costs related to contract execution; c) condition for advance payment disbursement is the Contractor’s unconditional, irrevocable, and payable on first demand bank or insurance guarantee issued for at least the amount of the advance payment; d) the content of the insurance or bank guarantee must be previously accepted by the Contracting Authority; e) settlement of the advance payment will be made by crediting it against the Contractor’s remuneration", simultaneously updating the numbering of subsequent paragraphs in §7. As a result, the Contracting Authority extended the deadline for submitting offers to 30.10.2026.
UPDATE 12.10.2026 The Contracting Authority has made changes in: • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor in Table 1. Offered storage units removing item 4 "Total nominal apparent power of PCS converters at least 50 MVA", simultaneously updating the numbering of subsequent rows in the table; • Attachment No. 2 – Functional and Utility Program – according to item XIV.3 of the Request for Proposal, the list of changes has been published on the server containing documentation constituting a business secret and is available to Bidders who have submitted a signed Confidentiality Statement. Participation conditions: - Knowledge and experience: The contract may be applied for by a Bidder who has the necessary knowledge and experience to execute the subject of the contract, including in the last 5 years, or if the business activity period is shorter – in that period: a) properly completed at least 4 EPC contracts with a total value of at least PLN 10,000,000.00 (in words: ten million zlotys) net, under which installations including energy storage systems were built, including at least one contract with a value of at least PLN 6,000,000.00 (in words: six million zlotys) net, under which: - a container energy storage system with a minimum power of 0.5 MW and capacity of at least 2 MWh equipped with an electrical energy management system was constructed, AND - telemechanics project was developed and agreed with the Distribution System Operator (DSO), AND - participation in the process of obtaining an occupancy permit and a concession for storage and delivery of electrical energy to the distribution network granted by the President of the Energy Regulatory Office (ERO)
or properly completed at least 3 EPC contracts with a total value of at least PLN 25,000,000.00 (in words: twenty-five million zlotys) net, under which installations with energy generation modules were built, including at least one contract with a value of at least PLN 10,000,000.00 (in words: ten million zlotys) net, under which: - integration with the plant network at an active industrial or production plant was carried out, AND - modernisation or replacement of MV switchgear, busbar bridges, LV switchgear with commissioning was performed, AND - telemechanics project was developed and agreed with the DSO.
b) properly completed at least 1 EPC contract worth at least PLN 5,000,000.00 (in words: five million zlotys) net, under which construction works in the construction and structural sector were performed; c) provided at least 1 servicing and warranty service for an energy storage system with a power not less than 0.5 MW and capacity not less than 2 MWh for at least 12 months.
Conditions specified in points a), b), and c) must be met jointly.
NOTE: For the purposes of this procedure, the Ordering Party understands the implementation of the contract in the EPC formula (Engineering, Procurement, Construction) as a comprehensive investment execution by a single entity, including at least: - supply and/or purchase of equipment and materials, - execution of works and/or installation, - commissioning and/or start-up, - tests, - transfer to operation, while the Contractor bears full contractual responsibility for the execution of the above scope (including subcontractors, if engaged).
NOTE: If values are given in a currency other than PLN, the amount will be converted to PLN according to the average exchange rate published by the National Bank of Poland on the date of the announcement of the request for proposal.
Method of condition assessment: Verification will be based on: • the Bidder's statement on meeting the participation conditions included in Attachment No. 1 to this request for proposal – Offer Form, • the list of completed contracts according to the template specified in Attachment No. 1 to this request – Offer Form, • evidence confirming proper execution of contracts and services indicated in the above list: final acceptance protocols, references, declarations with copies of invoices or other documents confirming proper execution of the contract issued by the entity for which the contracts were executed, clearly confirming the scope, execution date, and the client. - Technical potential: The contract may be applied for by a Bidder who has appropriate technical resources, infrastructure, and certifications enabling correct execution of the subject of the contract, including implemented and maintained systems compliant with the following standards: a) quality management compliant with ISO 9001 or equivalent, b) environmental management compliant with ISO 14001 or equivalent, c) information security compliant with ISO 27001 or equivalent.
Method of condition assessment: Verification will be based on: • the Bidder's statement concerning meeting participation conditions included in Attachment No. 1 to the request – Offer Form, • valid (as of the bid submission deadline) certificates issued by an independent, accredited certification body confirming operation of the required systems. - Persons capable of executing the contract: The contract may be applied for by a Bidder who has or will have at the Agreement signing date a team with the rights, qualifications, and experience necessary for proper execution of the contract, who will be assigned to perform the contract, consisting of at least: • site manager, having altogether: construction licenses for supervising construction works without restrictions in the structural and construction specialty; at least 2 years’ experience in managing construction works as site manager or construction manager, counted from the date of acquiring the aforementioned qualifications; valid (current year) certificate of membership in the relevant Regional Chamber of Civil Engineers; valid civil liability insurance (OC) required for persons performing independent technical functions in construction.

• specialist in power engineering project implementation, having altogether: experience in implementing power engineering investments including MV/LV networks, transformer stations, inverters, or switchgear – this condition is met if the person participated in at least 1 such investment within the last 5 years before bid submission deadline; experience in energy storage technology (LFP) – condition met if the person participated in at least 1 investment including electrical energy storage within the last 5 years before bid submission deadline; knowledge of building and energy regulations – condition met if the person participated in at least 1 investment requiring project documentation development, administrative decisions acquisition, or project inspections within the last 5 years before bid submission deadline; experience in managing technical and formal risks – condition met if the person participated in at least 1 investment including obtaining zoning decisions, building permits, industry approvals, or project inspections (zoning conditions, building permit, inspections) within the last 5 years before bid submission deadline.
Method of condition assessment: Verification will be based on the Bidder's statement on meeting participation conditions included in Attachment No. 1 to the request – Offer Form. - Economic and financial situation: The contract may be applied for by a Bidder who is in an economic and financial situation enabling proper execution of the contract, including: a) has financial means or creditworthiness amounting to at least PLN 15,000,000.00 (in words: fifteen million zlotys), b) has achieved net sales revenue of at least PLN 70,000,000.00 (in words: seventy million zlotys) in the last financial year, c) has no arrears in payment of taxes or social and health insurance contributions, d) has civil liability insurance related to business activity subject of the contract on an amount of at least PLN 30,000,000.00 (in words: thirty million zlotys).
Method of condition assessment: Verification will be based on: • the Bidder's statement on meeting participation conditions included in Attachment No. 1 to the request – Offer Form, • certificate from a bank or credit union confirming the amount of funds or creditworthiness, issued no earlier than 3 months before the bid submission deadline, • part of the financial statement (profit and loss account), or for entities not required to prepare it – other financial documents confirming revenue for the period (e.g., relevant PIT declaration with official confirmation), • certificate from the Tax Office and Social Insurance Institution issued no earlier than 3 months before bid submission deadline or equivalent documents from competent authorities in the country of the Bidder’s registered office or residence confirming no arrears in tax, fees, or social and health insurance contributions. In countries where such certificates are not issued, a proper declaration is admissible. • a copy of insurance policy or other document confirming possession of civil liability insurance with proof of premium payment (if required). If the insurance period ends during the bid validity period, the Bidder must declare to extend the insurance on at least the terms required by the request for proposal.
NOTE: If values are given in a currency other than PLN, the amount will be converted to PLN according to the average exchange rate published by the National Bank of Poland on the date of announcement. - Additional participation conditions: => Entities personally or capital-related with the Ordering Party are excluded from participation. Capital or personal relationships mean mutual connections between the Ordering Party or persons authorized to incur liabilities on behalf of the Ordering Party, or persons performing on behalf of the Ordering Party activities related to preparation and conducting of the contractor selection procedure and the Bidder, particularly: a) participating as partners in a civil company or partnership, b) holding at least 10% shares or stocks, unless a lower threshold results from legal provisions or other documents related to the project, c) serving as members of supervisory or management bodies, proxies, plenipotentiaries, d) being in marriage, direct kinship or affinity, second-degree lateral kinship or affinity, or in adoption, custody, or guardianship relations or cohabitating with the Contractor, their legal substitute or management or supervisory body members of contractor bidders, e) having such a legal or factual relationship with the Ordering Party that raises justified doubts about their impartiality or independence in connection with the contract award procedure.
Method of verifying grounds/lack of grounds for exclusion: Verification will be based on the Bidder's declaration on meeting participation conditions included in Attachment No. 1 to the request – Offer Form, and declarations of the Ordering Party and persons performing actions for the Ordering Party related to preparation and conducting the contractor selection procedure.
=> Entities are also excluded if circumstances described: a) in Article 7(1) of the Act of 13 April 2022 on special measures to counteract support for aggression against Ukraine and for the protection of national security (Journal of Laws 2025, Item 5014 consolidated text); b) in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of actions destabilizing the situation in Ukraine by Russia (Official Journal of the EU L 229 of 31.07.2014, p. 1 as amended) apply to them.
Method of verifying grounds/lack of grounds for exclusion: Verification will be based on the Bidder's declaration on meeting participation conditions included in Attachment No. 1 to the request – Offer Form.
NOTE! The above provisions apply accordingly to all contractors jointly applying for the contract (consortium members) and to third parties whose resources the Bidder cites to demonstrate meeting participation conditions. These entities are obliged to submit required statements confirming no grounds for exclusion from the procedure. - List of required documents/declarations: The offer must include: a) offer form along with attachments (in accordance with Annex No. 1 – Offer Form), b) Annex 1a with attachments – "Minimum equipment parameters to be confirmed by the Contractor", completed and signed by the Bidder c) declarations and documents resulting from the chapter CONDITIONS OF PARTICIPATION IN THE PROCEEDINGS AND GROUNDS FOR EXCLUSION of this Request for Proposal, d) confirmation of the deposit payment; e) power of attorney to act on behalf of the Bidder (if applicable), e) an extract or information from the National Court Register, Central Registration and Information on Business Activity, or another appropriate register, to confirm that the person acting on behalf of the bidder is authorized to represent it, unless the Contracting Authority can verify current data using free and publicly available databases, particularly public registers within the meaning of the Act of February 17, 2005, on IT implementation of entities performing public tasks (Journal of Laws of 2020, item 346, as amended). A bidder with its registered office or place of residence outside the territory of the Republic of Poland submits a document or documents issued in the country where it has its registered office or place of residence.
