Furthermore, service quality is crucial to ensure the comfort of users in the buildings of the City of Sotteville-Lès-Rouen. Thus, the Operator makes every effort to ensure compliance with the contractual provisions mentioned in this contract as well as optimal service continuity.
The contract duration takes into account the investment realization period, to which the operation-maintenance period is added. The latter must be sufficiently representative to measure the expected performance of the holder.
This consultation is aimed at economic operators specialized in heating operations.
Economic operators or grouping: no specific form of grouping is imposed by the contracting authority.
The contracting authority prohibits candidates from submitting their offers while acting as both:
1° As individual candidates and as members of one or more groupings
2° As members of several groupings
Economic operators may apply in the form of a grouping.
In accordance with article R.2142-23, the same economic operator may not be the representative of more than one grouping for the same market.
In case of awarding the contract to a joint grouping, the representative must be jointly liable with all members for their contractual obligations towards the contracting authority, to ensure optimal management of the missions and performance objectives related to the execution of the contract.
In accordance with article R.2142-26 of the public procurement code, the composition of the grouping cannot be modified between the submission date for applications and the signing date of the contract.
The contract involving built property, the representative of the grouping will necessarily be the company in charge of operation and maintenance, designated as the Operator in the contract documents.
The representative's insurance must cover the responsibilities attached to this function.
Minimum specific level of applications - minimum required capacity: The total turnover of the last three available financial years for the entire grouping or for the candidate in case of a single application must be equal to or greater than five million euros excluding tax per year.
In the case of a single application: the candidate must justify a turnover equal to or greater than 5 million euros excluding tax.
In the case of a grouping: the representative must justify a turnover equal to or greater than 5 million euros excluding tax.
If not, the application would be inadmissible.
Selection of applications: by applying criteria and sub-criteria. The contracting authority does not limit the number of candidates invited to submit tenders. However, following the examination of applications, if a candidate obtains a score of 50 / 100 or more based on the selection criteria mentioned in the notice, they will be admitted to phase 2 - initial offers.
The candidate who has not obtained the minimum score of 50/100 will not be allowed to compete in the initial offer phase and their application will be eliminated.
Candidates are allowed to submit a free variant, which must meet the following minimum requirements:
- No work may be proposed on the schools Renan Michelet, Michelet kindergarten, and on the Gymnase Michelet due to ongoing rehabilitation projects;
- The overall performance objectives described in paragraph 2.8 of this notice
- No variant regarding maintenance in terms of P2 (respecting the market perimeter). An improvement in energy performance. (Heating, ventilation, domestic hot water production, and electricity - relamping)
- An optimization of energy performance while respecting the expected objectives
Any candidate who submits a Variant Offer is obliged to submit a BASE OFFER, otherwise the entire offer will be declared irregular.
The contracting authority reserves the right not to proceed with negotiation and to award the contract based on the initial offers.
