The subject of the order is the comprehensive execution of the task consisting of the expansion and modernization of the sewage treatment plant, including equipping a third reactor, constructing a thickened sludge tank, a new wastewater inflow point, a retention tank, a grit chamber building, a shed for sludge, and numerous technological, sanitary, water supply, air, and electrical installations. The scope of work includes:
• modernization of existing technological facilities (pumping stations, bioreactors, blower stations, sludge presses, PIX stations, inflow stations, mechanical treatment buildings, and control rooms),
• construction of new facilities (tank for delivered wastewater, thickened sludge tank, retention tank, grit chamber building, shed for containers/sludge, sluice chamber, process water well),
• implementation of full technical infrastructure: sewerage networks, process water, air, electrical and control installations,
• reconstruction of hardened surfaces, and
• installation of a photovoltaic system with a capacity of approximately 50 kW.
The entire investment aims to increase the efficiency, reliability, and effectiveness of the sewage treatment plant.

The order is being carried out within the framework of the project: “Expansion of the sewage system in the Stężyca municipality.” Funding source: European Funds for Pomerania 2021–2027, action FEPM.02.12, and the client’s own funds. Contract no. FEPM.02.12-IZ.00-0003/25-00 for co-financing the Project: “Expansion of the sewage system in the Stężyca municipality”
The order in question is part of a larger order granted in parts. Each part constitutes a subject of a separate procedure. The total investment value exceeds the amount specified in the regulations referred to in Article 3, paragraph 1 of the Pzp Act.
Information about anticipated orders mentioned in Article 214, paragraph 1, points 7 and 8 of the PZP: repetition of similar construction works. The contracting authority anticipates the implementation of orders related to the repetition of similar construction works. The scope of the order will not exceed 20% of the value of the base order and will consist of performing similar works covered by the base order, particularly on: expansion, reconstruction, or modernization of technological facilities of the sewage treatment plant, including pumping stations, bioreactors, blower stations, sludge dewatering installations, reagent dosing stations, and technological buildings, performing construction works related to the construction of technological facilities of the sewage treatment plant, particularly technological tanks, retention tanks, sludge tanks, liquid waste inflow points, sluice chambers, and ancillary facilities, executing construction works in the field of technical infrastructure of the sewage treatment plant, covering the construction, expansion or reconstruction of sewage, water supply, process water networks, technological air installations, and electrical and control installations, performing works related to the installation, expansion, or modernization of technological and electrical installations and automation necessary for the proper functioning of the sewage treatment plant, executing construction works related to the reconstruction, restoration, or expansion of hardened surfaces, performing construction works aimed at expanding or supplementing renewable energy installations, including photovoltaic installations. The contracting authority will award the order in the mode of direct negotiation, provided there is a need on the part of the contracting authority and the provision of financial resources for this purpose after negotiations with the contractor.
Detailed requirements regarding construction progress, stages, and schedule requirements are included in the project contract attached to the SWZ.
Documents constituting the offer to be submitted include:
• Offer form (Attachment No. 1),
• JEDZ declaration of non-exclusion from the procedure and fulfillment of participation conditions. In the case of a joint application for the order by contractors, each contractor submits the JEDZ declaration. These declarations confirm the absence of grounds for exclusion and fulfilling the participation conditions to the extent that each contractor demonstrates compliance with the participation conditions.
• Power of attorney authorizing the submission of an offer if the offer is submitted by an agent;
• Bid security – if submitted in the form of a guarantee or surety - according to the conditions specified in the SWZ.
• Obligation of the entity providing resources and JEDZ declaration of the entity regarding non-exclusion and fulfillment of conditions – if applicable.
• Contractors jointly applying for the procurement include in the offer a declaration indicating which services will be executed by each contractor.
Qualified signatures used by contractors to sign all files must meet the requirements of the “Regulation of the European Parliament and the Council on electronic identification and trust services for electronic transactions in the internal market (eIDAS) (EU) No. 910/2014 - since July 1, 2016.
Acceptable amendments to the provisions of the concluded contract are possible within the scope specified in the contract template. A significant change to the provisions of the concluded agreement requires written form (annex to the contract) under penalty of nullity and requires the acceptance of each party to the contract. Acceptable changes to the contract are also specified in Article 455 of the PZP Act.
LOT-0001
Expansion and reconstruction of the sewage treatment plant in Stężyca-Delowo.
1. In the procurement procedure, the contracting authority requires subjective evidence.
2. The contracting authority calls the contractor whose bid has been rated highest, to submit subjective evidence within a specified period, not shorter than 10 days from the day of calling, which is valid at the date of submission.
3. Subjective evidence required from the contractor includes:
3.1. To confirm the absence of grounds for exclusion of the contractor from participation in the proceedings, the contracting authority requires the following documents:
3.1.1. information from the National Criminal Register in the scope specified in Article 108, paragraph 1, points 1 and 2; Article 108, paragraph 1, point 4 of the PZP Act regarding the ruling prohibiting participation in public procurement as a penal measure – prepared not earlier than 6 months before its submission;
3.1.2. a declaration by the contractor, in the scope of Article 108, paragraph 1, point 5 of the PZP Act, regarding the lack of belonging to the same capital group, within the meaning of the Act of February 16, 2007, on competition and consumer protection (Journal of Laws of 2020, item 1076), with another contractor who submitted a separate offer, partial offer, or application for participation in the proceedings, or declarations of belonging to the same capital group along with the documents or information confirming the preparation of the offer, partial offer or application for participation in the proceedings, regardless of another contractor belonging to the same capital group – the template is included in Attachment No. 4 to the SWZ.
3.1.3. declaration of the contractor on the current state of information contained in the declaration referred to in Article 125, paragraph 1 of the PZP Act regarding the grounds for exclusion from the proceedings indicated by the contracting authority, referred to in: Article 108, paragraph 1, point 3; Article 108, paragraph 1, point 4 concerning the ruling prohibiting participation in public procurement as a preventive measure; Article 108, paragraph 1, point 5 concerning the conclusion of an agreement with other contractors aimed at disturbing competition; Article 108, paragraph 1, point 6 of the PZP Act – the template is included in Attachment No. 3 to the SWZ.
3.1.4. Contractor's declaration regarding specific solutions in preventing support for aggression against Ukraine and serving the protection of national safety – the template is included in Attachment No. 5 to the SWZ.
3.2. To confirm that the contractor meets the conditions for participation in the proceedings, the contracting authority requires the following documents:
3.2.1. Contractor's declaration – List of construction works carried out not earlier than within the last 5 years counting from the expiry of the bid submission deadline, and if the business period is shorter – within this period, providing their type, value, date, and place of execution as well as the entities for which these works were executed, along with the annexes confirming whether these construction works were performed properly, with the evidence mentioned being references or other documents prepared by the entity for which the construction works were executed, and if the contractor cannot obtain these documents for reasons beyond their control – other appropriate documents – the template of the list of works is attached as Attachment No. 6 to the SWZ,
3.2.2. Contractor's declaration - List of persons designated to perform the order responsible for managing construction works, along with information on their professional qualifications, authorizations, experience and education necessary for the execution of the public order, as well as the scope of their activities and information on the basis of their availability – the template of the list of persons is attached as Attachment No. 7 to the SWZ.
3.2.3. Information from the bank or cooperative savings and credit union confirming the amount of available financial resources or creditworthiness of the contractor within a period not earlier than 3 months before its submission;
3.2.4. Documents confirming that the contractor is insured against civil liability related to the subject of the order, indicating the sum insured of this insurance.
4. If the contractor cannot submit the required subjective evidence specified in paragraphs 3.2.3 and 3.2.4 of the SWZ, the contractor submits other subjective evidence that sufficiently confirms meeting the condition described by the contracting authority regarding the economic or financial situation.
5. Contractors based outside the territory of the Republic of Poland. If the contractor has a registered office or residence outside the territory of the Republic of Poland, instead of:
- information from the KRK referred to in paragraph 3.1.1 of the SWZ submits information from the appropriate register, such as the court register, or, in the absence of such a register, another equivalent document issued by the relevant judicial or administrative authority of the country where the contractor has a registered office or residence, specified in paragraph. 3.1.1 of the SWZ. This document should be issued not earlier than 6 months before its submission.
6. The contractor is not obliged to submit subjective evidence that the contracting authority already possesses if the contractor indicates these sources and confirms their correctness and current status.
7. The contractor submits subjective evidence electronically, in data formats defined in regulations issued under Article 18 of the Act of February 17, 2005, on the informatization of the activities of entities carrying out public tasks (Journal of Laws of 2020, item 346 with amendments) with the reservation of formats mentioned in Article 6, paragraph 1 of the Act, taking into account the type of transmitted data.
8. The contracting authority does not require the submission of substantive means of proof
