1. The subject of the order is the design, supply, and installation of photovoltaic systems along with energy storage for the Municipal Communication Plant in Zawiercie as part of the implementation of the project titled: "Development of decentralized energy based on RES for public utility buildings in the Municipality of Zawiercie 3".
2. The scope of work includes:
inventory of the electrical installation necessary for design;
application for necessary agreements, decisions (if necessary), including: application for connection conditions for connecting the generation source, building permits or notifications;
preparation of design documentation and its agreement with the Ordering Party;
modernization and equipping the main distribution board of the building necessary for the safe operation of the photovoltaic installation;
construction of a photovoltaic installation on the building and land with a total capacity of at least 300.00 kWp;
obtaining all administrative and legal permits,
installation of supporting structures for PV modules;
installation of PV modules on supporting structures;
installation of inverter(s);
installation of energy storage with an integrated energy management system,
laying of cabling on the DC and AC side using appropriate devices;
connecting the PV installation to the main electrical distribution board for the facility;
protection of the photovoltaic installation from lightning strikes;
making seals, post-installation repairs;
performing tests to check the correct operation of the system, including equipment;
startup of the system and adjustments;
marking the distribution board and cable connection informing about the PV installation and electric energy storage (if applicable)
electrical measurements;
training for the Ordering Party's and User's staff;
notifying the installation to the energy company and PSP Zawiercie;
preparation of as-built documentation.
3. The supplied devices must be unused and brand new, produced no earlier than 2025, from mass production considering the configuration options provided by the manufacturer for the offered model of equipment and coming from an official distribution channel to the European market. The Ordering Party does not allow equipment that is a prototype, and the applied technology and its individual components should be validated in operational practice.
4. A detailed description of the subject of the order as well as the description of how to execute parts of the order can be found in the Functional-Utility Program (PFU), which is an annex to the SWZ.
5. The Ordering Party simultaneously informs that, according to the provisions of the Draft Agreement Provisions, it will require the Contractor selected in the procedure for the duration of the contract to establish insurance coverage (according to the principles specified in the Draft Agreement Provisions) and to provide security for proper contract execution, in accordance with the content of the SWZ.
6. The Ordering Party requires that the Contractor provides:
a) product warranty for the DC/AC inverters - min. 10 years,
b) product warranty for the energy storage - min. 8 years,
c) warranty for the remaining installation equipment at least 8 years
7. Time to eliminate failures – up to 7 working days from the moment they are reported on business days from 7:00 to 15:00.
8. Response time to service reports – up to 24 hours from the moment of reporting on working days from 7:00 to 15:00 under the principles resulting from the Agreement.

9. Where the SWZ, including the Functional-Utility Program (PFU) or other ordering documents specifies a trademark, patent or origin, source, or specific process that characterizes products or services supplied by a particular Contractor or indicates standards, technical evaluations, technical specifications and reference technical systems mentioned in Article 101 paragraph 1 point 2 and paragraph 3 of the act, the Ordering Party, in accordance with Article 99 paragraph 5 of the act, allows the submission of an equivalent offer or, according to Article 101 paragraph 4 of the act, the proposal of “equivalent” solutions in relation to those indicated in the Description of the subject of the order, on the condition that they ensure obtaining technical parameters no worse than those assumed in the SWZ, including the PFU.
10. According to Article 101 paragraph 5 of the Pzp act, the Contractor who refers to solutions equivalent to those described by the Ordering Party (in terms of standards, technical evaluations, technical specifications and reference technical systems mentioned in Article 101 paragraph 1 point 2 and paragraph 3 of the Pzp act) must prove in the offer, in particular using the object evidence referred to in Articles 104-107 of the Pzp act, that the proposed solutions meet the requirements specified in the description of the subject of the order to an equivalent extent.
11. The Ordering Party requires the submission with the offer of specific evidence, i.e. specifications of the offered devices, confirming that the devices meet the requirements contained in the description of the subject of the order as well as the minimum technical parameters indicated by the Ordering Party, in accordance with Annex No …. to the SWZ. The Ordering Party provides for the supplementation of the specific evidence if the Contractor did not submit it or if the submitted specific evidence is incomplete.
12. Considering the requirements contained in Article 101 paragraph 1 of the Pzp act regarding the accessibility of all users, particularly persons with disabilities, the Ordering Party requires, where the subject of the order requires it, to carry out the installation in a manner that ensures the ability to perform service activities for persons with disabilities.
