The contractor is obliged to execute the subject of the order in accordance with the principle of "do no significant harm" (DNSH), as referred to in Article 17 of Regulation (EU) 2020/852, by fulfilling six environmental objectives, confirmed by a declaration and relevant documents/certificates (applying to all packages) in accordance with the detailed provisions specified in the SWZ in chapter II section 1 point 3):
1. Climate change mitigation: the offered devices (if applicable) must feature high energy efficiency, limiting electricity consumption - The contractor submits a declaration and, if available, an Energy Star certificate or equivalent.

Subject of the order is the Delivery and Expansion of Teleinformatics Infrastructure and IT Systems at the Pulmonology and Thoracic Surgery Center in Bystra (repeated procedure for 7 packages) within the implementation of the project titled "Implementation of modern digital solutions at the Pulmonology and Thoracic Surgery Center in Bystra to increase the efficiency and safety of healthcare" funded by the National Recovery and Resilience Plan - component D "Efficiency, accessibility, and quality of the healthcare system" - investment D1.1.2 "Accelerating the processes of digital transformation in healthcare through further development of digital services in healthcare" being an element of component D "Efficiency, accessibility, and quality of the healthcare system" in the scope of Package No. 6: Delivery of qualified electronic signatures for handling electronic documentation. A detailed description of the package is indicated in Appendix No. 2 to the SWZ - detailed description of the object of the order - further OPZ and in Appendix No. 7C to the SWZ - draft contracts concerning Package No. 6. The contractor is obliged to execute the subject of the order in accordance with the principle of "not causing significant harm" to the environment (DNSH - Do No Significant Harm), as referred to in Article 17 of Regulation (EU) 2020/852, by meeting six environmental objectives, confirmed by a declaration and appropriate document/certificate (for all Packages) in accordance with the detailed provisions specified in the SWZ in chapter II § 1 item 3) j.n.: 1. Mitigation of climate change: offered devices (if applicable) must be characterized by high energy efficiency, limiting electricity consumption - the contractor submits a declaration and, if available, an Energy Star certificate or equivalent. 2. Adaptation to climate change: Equipment and software must be designed to maintain the declared performance specified by the manufacturer taking into account the risks associated with climate change (heat waves, extreme rainfall, and strong winds) - the contractor submits a declaration. 3. Sustainable use and protection of water and marine resources: The manufacturing process of the equipment must not violate water protection objectives - the contractor submits a declaration and, if available, an ISO 14001 certificate or Environmental Product Declaration or an equivalent document. 4. Transition to a circular economy: The subject of the order must be durable and repairable, and the software does not force premature disposal of functioning equipment - the contractor submits a declaration and, if available, a recycling certificate (e.g., EPEAT, TCO) or an equivalent document. 5. Prevention of pollution and its control: Offered equipment (if applicable) must be free of hazardous substances beyond the limits set by EU law - the contractor submits a declaration and, if available, a CE certificate or equivalent document. 6. Protection and restoration of biodiversity and ecosystems: The acquisition of raw materials and the final disposal of equipment must not negatively affect protected areas - the contractor submits a declaration and, if available, a WEEE certificate or an equivalent document. Requirements regarding accessibility - According to Article 100 § 1 and 2 of the Public Procurement Law, the subject of the order must meet the accessibility requirements for people with disabilities and universal design according to the EN 301 549 standard. The requirements in this regard are detailed in the SWZ Chapter II § 1 item 4). Confirmation of meeting the accessibility requirements is the submission along with the offer of a declaration of accessibility or a justified deviation from WCAG 2.1 AA or EN 301 549 according to the descriptions indicated in that point of the SWZ. The contractor may additionally submit supporting documents such as an Accessibility Declaration or the results of an external audit. The contracting authority requires the offering of a subject of the order that meets the requirements specified in the SWZ in Chapter II § 1 item 7) - failure to meet the specified requirements will result in the rejection of the offer accordingly under Article 226 § 1 item 17 or item 19 of the Public Procurement Law. The term of execution of the order until July 15, 2026 - in the context of Package No. 6, the execution deadline is an evaluated criterion. The contracting authority, acting in accordance with Article 436 point 1 of the Public Procurement Law, indicates that defining the deadline for contract execution by a specific date arises from objective reasons. In this case, it should be emphasized that determining the execution period for the task by a specific date is justified by objective reasons, due to the tasks burdening the contracting authority arising directly from the grant agreement concluded with the State Treasury - Minister of Health regarding granting funding for the investment task carried out from the National Recovery and Resilience Plan - component D - investment D1.1.2. Based on the concluded agreement, the contracting authority is obliged to implement the undertaking in the scope of the object until 15.07.2026 (initially set for 31.05.2026). In the event of failure to comply with the provisions of the CPiT agreement in Bystra, the grant will be lost in whole or in part. The necessity to indicate a date instead of a period arises from the fact that previous proceedings, which specified deadlines in calendar days, were annulled (Article 255 point 1 and point 2 of the Public Procurement Law) due to the lack of submitted offers or due to the rejection of all submitted offers depending on the indicated packages. The contracting authority exercised due diligence, initiating them in advance. The current situation (annulment) has created an objective need for the immediate commencement of a new procedure. Indicating a cut-off date is necessary to meet the deadlines arising from the grant agreement, and the urgency does not stem from the contracting authority's negligence but from the need to respond to the outcomes of previous proceedings and comply with the provisions of the agreement with the KPO.
