1. The subject of the order includes: 1) delivery of 4 brand new low-floor city buses with an overall length ranging from 11.5 meters to 13.5 meters, zero-emission electric drive, hereinafter referred to as buses; 2) delivery, installation, connection, execution of connections and initial commissioning of 2 brand new mobile wired chargers with a capacity of 80 kW, allowing for charging one bus at a power of 80 kW or two buses simultaneously at 40 kW each, hereinafter referred to as Plug-in chargers or chargers; 3) supply of necessary tools (including diagnostic devices) with necessary interfaces and software along with licenses in quantity and scope allowing for free use of all functionalities of buses; 4) training of employees of the Operator - City Public Transport Company Sp. z o.o. ul. Narutowicza 59, 97-500 Radomsko; 5) warranty and post-warranty service for buses and chargers; 6) granting internal servicing and operation authorization for buses (ASO) to the Operator, i.e., the City Public Transport Company Sp. z o.o. ul. Narutowicza 59, 97-500 Radomsko; 7) providing necessary instructions, catalogs, specifications, technical documentation, and other studies concerning the subject of the order along with licenses for the use of this documentation and translation into Polish; 8) delivery of necessary software and systems mentioned in the description of the subject of the order along with documentation and licenses; 9) performance of other services, deliveries specified in the description of the subject of the order and the agreement, the template of which constitutes Appendix No. 7 to the SWZ along with annexes. 2. A detailed description of the subject of the order including formal requirements and detailed requirements, technical parameters, equipment, and warranty and service conditions that must be met and possessed by the offered subject of the order includes: 1) description of buses - Appendix No. 8.1 to SWZ; 2) description of Plug-in chargers - Appendix No. 8.2 to SWZ; 3) model agreement Appendix No. 7 to SWZ along with warranty service conditions for the bus which constitute Annex No. 3 to the draft agreement and other annexes including the list and description of tools and special devices for repair and service of buses.

1. A detailed description of the subject of the order including formal requirements and detailed requirements, technical parameters, equipment, and warranty and service conditions that must be met and possessed by the offered subject of the order includes: 1) description of buses - Appendix No. 8.1 to SWZ; 2) description of Plug-in chargers - Appendix No. 8.2 to SWZ; 3) model agreement Appendix No. 7 to SWZ along with warranty service conditions for the bus which constitute Annex No. 3 to the draft agreement and other annexes including the list and description of tools and special devices for repair and service of buses. 3. The subject of the order must be executed in accordance with the contract along with warranty service conditions, the draft of which constitutes Appendix No. 7 to the SWZ, descriptions attached to the SWZ, and applicable regulations. 4. The contracting authority will entrust the implementation of public transport services using buses and chargers that are the subject of the order to the public transport operator: City Public Transport Company Sp. z o.o. in Radomsko. 5. According to Article 101 paragraph 4 of the Act, in the event that the description of the subject of the order contains references to standards, technical assessments, approvals, technical specifications, and systems of technical reference referred to in Article 101 paragraph 1 point 2 and paragraph 3 of the Act, and such references are not accompanied by the expression “or equivalent”, the contracting authority allows equivalent solutions to those described in any such standard, technical assessment, approval, technical specification, or system of technical reference. Therefore, it should be assumed that each: standard, technical assessment, approval, technical specification, and technical reference system occurring in the description of the subject of the order is accompanied by the words “or equivalent.” If the description of the subject of the order uses the name of the material(s) or device(s), parameters identifying the manufacturer, origin, they serve only to establish the characteristics and quality of these materials or devices; the use of materials or devices (generally equivalent products) from other manufacturers is permitted when carrying out the order. The contracting authority allows equivalent solutions, provided that the offered object of the order will have the same or better technical, substantive, usability, quality, and functionality parameters. The contracting authority allows the use of materials and devices with parameters at least identical to the main parameters of the materials and devices described in the SWZ, which are necessary to ensure the essential function provided for each material or device. If in the description of the subject of the order, SWZ, or appendices there is a requirement to have a certificate issued by a conformity assessment body or reports from tests conducted by that body as evidence confirming compliance with the requirements or characteristics specified in the description of the subject of the order or conditions for the execution of the order it means that the contracting authority also accepts certificates issued by other equivalent conformity assessment bodies. If a specific label is required, the contracting authority accepts all labels confirming that the given deliveries or services meet the equivalent requirements specified by the contracting authority's label. The contractor who refers to equivalent solutions with respect to the above requirements or references of the contracting authority is obliged to demonstrate in the content of the offer to what extent they are submitting an equivalent offer and is obliged to present evidence in the offer that the supplies or services they are offering meet the requirements specified by the contracting authority. 6. The contracting authority does not foresee the possibility of granting orders referred to in Article 214 paragraph 1 point 8 of the Act.
