Electrical Energy Storage (EES) with a minimum power of 39 MW The subject of the contract is the implementation of all necessary actions in the "design and build" formula regarding the design, agreement, and execution of all works, including construction and assembly, electrical, telecommunications, sanitary works, and supplies necessary for the proper execution and operation of the Electrical Energy Storage with a power not less than 39 MW and capacity not less than 165 MWh (hereinafter: "EES") along with medium voltage/low voltage connections and necessary accompanying infrastructure, for the purpose of delivering power to the grid of the relevant Distribution System Operator (DSO) in accordance with the Connection Conditions and the requirements of the Distribution System Operator (DSO), as well as obtaining all required permits necessary for the proper use of the EES by the Contracting Authority and providing warranty and service services during the warranty period.

Due to limitations of the Competitiveness Database related to the inability to add the correct operational program, the Contracting Authority informs that the call added in the BD is a technical solution only. The project is carried out under priority program no. 1.15 "Energy transformation Electrical Energy Storages and related infrastructure to improve the stability of the Polish power grid." This program is implemented by the National Fund for Environmental Protection and Water Management (NFOŚiGW) and financed from the Modernization Fund.
UPDATE 29.09.2026 The Contracting Authority made changes in: • Request for Proposal point XI.5. from "* Guaranteed RTE efficiency will be calculated separately for each part of the EES according to the connection point at S-41 and S-42 stations" to "* Guaranteed RTE efficiency will be calculated separately for each part of the EES according to the connection point at S-41 and S-42 stations, excluding energy consumption for the general own needs of the entire EES. AC-AC RTE measurement should be referred to the standard ambient temperature of 25°C"; • Attachment 1A – Minimum equipment parameters to be confirmed by the Contractor – in Table 1. Offered storage units point 1 changed from "Usable capacity" to "Rated capacity"; • Attachment 1A – Minimum equipment parameters to be confirmed by the Contractor – in Table 3. Offered medium voltage/low voltage power transformers point 1 from "Transformer power: up to 4.5 MVA" to "Transformer power: up to 4.5 MVA or higher provided other requirements specified in the Request for Proposal documentation are met and that the use of a higher transformer power will not negatively affect the parameters and safety of the installation operation"; • Attachment 2 – Functional and Utility Program – according to point XIV.3 of the Request for Proposal, the list of changes was published on the server containing documentation constituting a business secret and is available to Offerors who have submitted a signed Confidentiality Statement. Due to the above, the Contracting Authority extended the deadline for submission of bids to 28.10.2026.
UPDATE 05.10.2026 The Contracting Authority made changes in: • Request for Proposal point VII.3. from "Planned contract conclusion date: 10/2026" to "Planned contract conclusion date: 11/2026"; • Attachment 1A – Minimum equipment parameters to be confirmed by the Contractor updated document designation from "Attachment no. 1 to Request for Proposal no. 1/2026" to "Attachment no. 1A to Request for Proposal no. 1/2026"; • Attachment 1A – Minimum equipment parameters to be confirmed by the Contractor in Table 2. Offered bi-directional converters PCS point 1 changed from "Maximum rated inverter power: 150 kW" to "Maximum loss of available power due to failure of a single inverter or its module, including the consequences of protection actions: 1100 kW", point 2 from "Maximum THD distortion factor: 1.5 %" to "Maximum THD distortion factor at rated power, for charging and discharging: 8 %" and adding point 3 "Maximum THD distortion factor of current measured on the 6kV side at each connection point of the EES circuit to switchboards S-41 and S-42, in each phase at the rated power of the circuit, for charging and discharging (using appropriate filtering systems): 3 %", simultaneously updating the numbering of subsequent rows in the table; • Attachment 2 – Functional and Utility Program – according to point XIV.3 of the Request for Proposal, the list of changes was published on the server containing documentation constituting a business secret and is available to Offerors who have submitted a signed Confidentiality Statement; • Attachment 6 – Contract template with the Contractor under §7 ADVANCES AND PARTIAL PAYMENTS adding item 3: "Detailed rules and conditions of advance payments are defined in Attachment no. 14 to the Contract taking into account the following requirements: a) the advance payment is one-time and may be made up to a maximum of 20% of the Contract value; b) the advance payment may be allocated by the Contractor exclusively for costs related to contract execution; c) the condition for paying the advance is submission by the Contractor of an unconditional, irrevocable, and payable on first demand bank or insurance guarantee issued for an amount not lower than the advance payment; d) the content of the bank or insurance guarantee must be previously approved by the Contracting Authority; e) the advance payment will be settled by crediting it against the Contractor's remuneration", simultaneously updating the numbering of subsequent paragraphs in §7. Due to the above, the Contracting Authority extended the deadline for submission of bids to 30.10.2026.
UPDATE 12.10.2026 The Contracting Authority made changes in: • Attachment 1A – Minimum equipment parameters to be confirmed by the Contractor in Table 1. Offered storage units removing point 4 "Total rated apparent power of PCS converters at least 50 MVA", simultaneously updating numbering of subsequent rows in the table; • Attachment 2 – Functional and Utility Program – according to point XIV.3 of the Request for Proposal, the list of changes was published on the server containing documentation constituting a business secret and is available to Offerors who have submitted a signed Confidentiality Statement. Due to the above, the Contracting Authority extended the deadline for submission of bids to 02.11.2026.

Conditions for participation: - Knowledge and experience: The contract may be awarded to a bidder who has the necessary knowledge and experience to perform the subject of the contract, including in the last 5 years, or if the business activity period is shorter – during this period: a) has properly completed at least 4 EPC contracts with a total net value of at least PLN 10,000,000.00 (in words: ten million zloty), under which installations with energy storages were built, including at least one contract with a value of at least PLN 6,000,000.00 (in words: six million zloty) net, under which: - a container energy storage with a minimum power of 0.5 MW and minimum capacity of 2 MWh equipped with an electric energy management system was built, AND - telemechanics project was prepared and agreed with the DSO, AND - participated in the process of obtaining usage permits and licenses for storage and injection of electrical energy to the distribution network granted by the President of the Energy Regulatory Office
or properly completed at least 3 EPC contracts with a total net value of at least PLN 25,000,000.00 (in words: twenty-five million zloty), under which installations with energy generation modules were built, including at least one contract with a value of at least PLN 10,000,000.00 (in words: ten million zloty) net, under which: - integration with the plant network on the premises of an operational industrial or production facility was performed, AND - modernization or replacement of medium voltage switchgear, busbars, low voltage switchgear with commissioning was performed, AND - telemechanics project was prepared and agreed with the DSO.
b) has properly completed at least 1 EPC contract with a value of at least PLN 5,000,000.00 (in words: five million zloty) net, under which construction works in structural and construction industry were performed; c) has provided at least 1 warranty and service service for an energy storage with a power not less than 0.5 MW and capacity not less than 2 MWh for a period of at least 12 months.
Conditions specified in points a), b) and c) must be fulfilled collectively.
NOTE: For the purposes of this procedure, by implementation of the contract in EPC (Engineering, Procurement, Construction) formula the Contracting Authority understands comprehensive execution of the investment by one entity, including at least: - delivery and/or acquisition of equipment and materials, - execution of works and/or assembly, - commissioning and/or start-up, - testing, - handover for operation, with the Contractor bearing full contractual responsibility for performing the above scope (including subcontractors’ actions, if engaged).
NOTE: If amounts are stated in a currency other than PLN, the amount will be converted to PLN at the average exchange rate of the currency published by the National Bank of Poland on the day of the Request for Proposal announcement. Condition assessment method: Verification will be based on: • The Bidder's declaration on fulfilling the participation conditions in the procedure, contained in Annex 1 to this enquiry – Offer Form, • The list of completed contracts according to the template specified in Annex 1 to this enquiry – Offer Form, • Evidence confirming proper execution of the contracts and services indicated in the above list: final acceptance protocols, references, statements together with a copy of the invoice or other documents confirming proper execution of the order issued by the entity for which the orders were performed, clearly confirming the scope of the order, completion date, and the entity for which the order was performed. - Technical potential: The contract may be applied for by a Bidder who has adequate technical facilities, infrastructure, and certification enabling proper execution of the subject of the contract, including implemented and maintained systems according to the following standards: a) quality management compliant with ISO 9001 or equivalent, b) environmental management compliant with ISO 14001 or equivalent, c) information security management compliant with ISO 27001 or equivalent.
Condition assessment method: Verification will be based on: • The Bidder's declaration on fulfilling the participation conditions in the procedure, contained in Annex 1 to the enquiry – Offer Form, • Current (valid on the date of submission deadline) certificates issued by an independent, accredited certification body confirming operation of the required systems. - Personnel capable of contract execution: The contract may be applied for by a Bidder who has and/or will have as at the Contract signing date, a team possessing the rights, qualifications, and experience necessary for proper contract execution, designated for contract realization, comprising at least: • site manager, possessing altogether: built environment construction qualifications with no restrictions in the construction and structural specialty; at least 2 years' experience in managing construction works as site manager or construction manager, counted from the date of acquiring the rights mentioned above; valid (current year) certificate of membership in the proper Regional Chamber of Civil Engineers; valid civil liability insurance (OC) required for persons performing independent technical functions in construction.
• construction manager, possessing: built environment construction qualifications with no restrictions in the construction and structural specialty
• electrical / power electrical works manager, possessing: built environment construction qualifications with no restrictions in the installation specialty in the scope of electrical and power electrical networks, installations and devices
• specialist, possessing: SEP qualification certificates in operation (E) and supervision (D), also including performance of measurements;
• specialist in the implementation of power engineering projects, possessing altogether: experience in executing power engineering investments including medium/low voltage networks, transformer stations, inverters or switchgears – this condition will be considered fulfilled if the indicated person has participated in at least 1 such investment within the last 5 years before the submission deadline; experience in energy storage technology (LFP) – considered fulfilled if the indicated person has participated in at least 1 investment including electrical energy storage during the last 5 years before submission deadline; familiarity with construction and energy regulations – considered fulfilled if the person participated in at least 1 investment requiring project documentation preparation, obtaining administrative decisions or carrying out investment acceptances within the last 5 years before submission deadline; experience in managing technical and formal risks – considered fulfilled if the person participated in at least 1 investment including the process of obtaining decisions on development conditions, building permits, industry agreements, or investment acceptances (WZ, PB, building permit, acceptances) during the last 5 years before submission deadline.
Condition assessment method: Verification will be based on the Bidder's declaration on fulfilling the participation conditions in the procedure, contained in Annex 1 to the enquiry – Offer Form. - Economic and financial situation: The contract may be applied for by a Bidder who is in an economic and financial situation enabling proper execution of the contract, including: a) having funds or creditworthiness totalling at least PLN 15,000,000.00 (in words: fifteen million zloty), b) net sales revenue in the last fiscal year of at least PLN 70,000,000.00 (in words: seventy million zloty), c) not being in arrears with payment of taxes or social and health insurance contributions, d) having civil liability insurance related to the subject of contract with coverage of at least PLN 30,000,000.00 (in words: thirty million zloty).
Condition assessment method: Verification will be based on: • The Bidder's declaration on fulfilling participation conditions contained in Annex 1 to the enquiry – Offer Form, • Bank or credit union certificate confirming the amount of available funds and/or creditworthiness, issued no earlier than 3 months before the submission deadline, • Part of financial statement (profit and loss account), or for entities not obliged to prepare it, other financial documents confirming revenue for the indicated period (e.g., relevant PIT declaration with confirmation of receipt), • Certificates issued no earlier than 3 months before submission deadline from the Tax Office and Social Insurance Institution or equivalent documents issued by competent authorities in the country where Bidder is registered or resides, confirming no arrears in taxes, fees, or social and health insurance contributions. If such documents are not issued in a given country, a proper declaration in this regard is acceptable. • Copy of the insurance policy or other document confirming possession of the liability insurance along with confirmation of premium payment (if required). If the insurance payment period ends during the binding period of the Bidder's offer, the Bidder must additionally declare they will extend the insurance under at least the conditions required in the enquiry.
NOTE: If values are given in a currency other than PLN, they will be converted to PLN according to the average exchange rate of that currency published by the National Bank of Poland on the day of the enquiry announcement. - Additional participation conditions: => Entities personally or capital-related to the Contracting Authority are excluded from participation. Personal or capital relations mean mutual connections between the Contracting Authority or persons authorized to incur commitments on its behalf or persons acting on behalf of the Contracting Authority in activities related to preparation and conduct of the contractor selection procedure and the Bidder, involving in particular: a) participating in a company as a partner in a civil or personal partnership, b) holding at least 10% of shares or stocks, unless a lower threshold results from law or is set in documents related to the venture, c) holding the function of a member of supervisory or management bodies, proxy, attorney, d) being in marriage, kinship or affinity in a direct line, kinship or affinity in a collateral line up to second degree, or related by adoption, custody or guardianship or cohabiting with the Contractor, its legal representative or members of management or supervisory bodies of contractors seeking the contract, e)\tbeing in such a legal or factual relationship with the Contracting Authority that there is justified doubt about their impartiality or independence in connection with the contract award procedure.
Verification method of exclusion grounds/no grounds: Verification will be based on the Bidder's declaration on fulfilling participation conditions contained in Annex 1 to the enquiry – Offer Form and declarations of the Contracting Authority and persons acting on its behalf in procedures related to contractor selection.

NOTE! The above provisions apply correspondingly to all contractors jointly applying for the contract (consortium members) and to third parties whose resources the Bidder relies on to demonstrate compliance with participation conditions. These entities are obliged to submit required declarations confirming no grounds for exclusion from participation. - List of required documents/declarations: The offer must include: a) Offer form with annexes (in accordance with Annex 1 – Offer Form), b) Annex 1a with appendices – "Minimum device parameters to be confirmed by the Contractor", completed and signed by the Bidder, c) Statements and documents arising from the section CONDITIONS OF PARTICIPATION AND GROUNDS FOR EXCLUSION of this enquiry, d) Confirmation of bid bond payment; e) Power of attorney to act on behalf of the Bidder (if applicable), e) Extract or information from the National Court Register, Central Registration and Information on Business or other relevant register to confirm that the person acting on behalf of the Bidder is authorized to represent it, unless the Contracting Authority can verify current data via free and publicly available databases, especially public registers within the meaning of the Act of 17 February 2005 on informatization of the entities performing public tasks (Journal of Laws 2020, item 346, as amended). A Bidder with registered office or residence outside the territory of the Republic of Poland shall submit a document or documents issued in the country where it has its registered office or residence.
