1. The subject of the contract is the supply and installation of photovoltaic systems and solar collectors in a design and build mode. 2. The contract has been divided into two parts:
Part I - Supply and installation of photovoltaics and energy storage in a design and build mode
Part II - Supply and installation of solar collectors in a design and build mode
The Contractor may submit a bid for all or selected parts of the contract. The Contracting Authority does not limit the number of parts for which the contract may be awarded to the same Contractor.
3. The detailed scope of the subject of the contract and the conditions for the implementation of the investment (for both parts of the contract) are defined, in addition to the Terms of Reference (SWZ), by the following documents:
a) Functional-Utility Program (PFU) (Annex 12 to SWZ);
b) Draft contract provisions (Annex 2a and 2b to SWZ);
c) Contractor's offer with attachments,
d) Explanations to the SWZ (if applicable).
4. The Contracting Authority requires the Contractor to provide a quality warranty and guarantee for defects on the completed subject of the contract for a minimum period of 72 months (applicable to Part I and II). NOTE: The warranty and guarantee period for defects on the completed subject of the contract constitutes a criterion for evaluating offers (applicable to Part I and II). At the same time, the Contracting Authority requires warranty periods for the installed equipment and installations in accordance with the description contained in the PFU. If the warranty period provided by the manufacturer of the equipment or installation is longer than the periods specified in the PFU, the manufacturer's warranty period shall apply.
5. The Contracting Authority does not foresee awarding contracts based on Article 214, paragraph 1, points 7 and 8 of the Public Procurement Law (Pzp).
6. The Contracting Authority does not foresee a mandatory site visit.
7. SUBJECT EVIDENCE
7.1. To confirm that the offered subject of the contract meets the requirements, features or criteria specified by the Contracting Authority, which are necessary for conducting the proceeding, the Contracting Authority requires the submission of subject evidence along with the offer.
7.2. The Contracting Authority requires the submission of the following subject evidence along with the offer (applicable to Part I and II):
- technical specification of the offered subject of the contract (filled out by the Contractor according to the template constituting Annex 13 to SWZ for Part I and Annex 14 to SWZ for Part II),
- including data sheets, manufacturer’s declarations, certificates, and other documents confirming compliance with minimum requirements (applicable to photovoltaic modules, inverters and energy storage for Part I of the contract and solar collectors for Part II).
7.3. If the Contractor does not submit the subject evidence or if the submitted evidence is incomplete, the Contracting Authority will summon the Contractor to submit or supplement it within the specified deadline.
8. The subject of the contract will be implemented as part of the funding from the Regional Operational Program for Greater Poland 2021-2027, Priority 10 Just Transformation of Eastern Greater Poland, Activity 10.6 Bringing Eastern Greater Poland closer to achieving climate neutrality | European Funds for Greater Poland.
9. The Contracting Authority will apply Article 139, paragraph 1 of the Pzp, meaning that the Contracting Authority will first conduct the examination and evaluation of offers and then qualify the Contractor whose offer has been evaluated the highest for the absence of grounds for exclusion and fulfillment of the conditions for participation in the proceeding.
10. The Contracting Authority, using the provisions of Article 257 Pzp, informs that it may annul the proceedings for the award of the contract if the public funds which the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it.
11. (pertaining to both Part I and Part II) The Contracting Authority requires that the Contractor whose offer is chosen as the most favorable, before concluding the contract, provide a performance bond in the amount of 3% of the total (gross) price quoted in the offer for carrying out the entire subject of the contract. The bond serves to cover claims due to non-performance or improper performance of the contract. Detailed provisions are contained in Chapter XXIII of the SWZ.
LOT-0001
Part I – Supply and installation of photovoltaics and energy storage in a design and build mode.
Part I of the contract: supply and installation of photovoltaics and energy storage in a design and build mode:
1) the entire task, i.e. the material scope implemented in the municipality of Kawęczyn includes work that will be carried out in a design and build mode, related to:
- preparation of comprehensive, multi-discipline design documentation, covering all work specified in the functional-utility program regarding the supply and installation of photovoltaic systems and photovoltaic systems with energy storage for residential buildings and public utility buildings, preparation of as-built documentation, obtaining legally required opinions, decisions, agreements, permits, and notifications,
- carrying out the work specified in the functional-utility program regarding the supply and installation of photovoltaic systems and photovoltaic systems with energy storage for residential and public utility buildings, installing the system, training users, and performing authorship supervision over the investment implementation.
Note:
1. The Contracting Authority requires the implementation of the subject of the contract in two stages, namely:
Stage I covering residential buildings and residents' properties
Stage II covering public utility buildings.
2. The Contracting Authority informs that before commencing installation work, the design documentation will require approval respectively by the resident, the Contracting Authority and the Marshal's Office of the Greater Poland Voivodeship. The approval of the documentation does not relieve the Contractor of responsibility for defects and shortcomings in the subject of the contract.
2) The Contractor will be obliged to perform all works, services, and inspections that will ensure the validity of the guarantee of individual devices/elements of the installation – in accordance with the guidelines set by the respective manufacturer of the devices/elements of the installation in this regard – throughout the warranty period, in accordance with the offer submitted during the proceeding.
3) The equipment and construction products used by the Contractor must:
– be brand new, not older than 2025,
– have user manuals in Polish,
– have a written guarantee from the manufacturer or Contractor regarding quality,
– be placed on the market in accordance with the provisions of the Act of April 13, 2016 on the system of conformity assessment and market surveillance (Journal of Laws of 2025, item 568),
– have a declaration of conformity with the regulations specified in the EU harmonization legislation and the provisions of European Parliament and Council Regulation (EU) No. 305/2011 of March 9, 2011 establishing harmonized conditions for the marketing of construction products and repealing Council Directive 89/106/EEC - “CE” marking or have a national declaration of performance issued based on the provisions of the Act of April 16, 2004 on construction products (Journal of Laws of 2021, item 1213) - “B” marking,
- other requirements for photovoltaic installations and energy storage have been specified in the PFU.
3. To carry out the task, the Contractor is obliged to provide, at its own expense, the materials, machines, and devices necessary for its execution and to perform all accompanying works, tasks, and actions necessary for the execution of the order. The delivered materials must comply with the requirements for products allowed for trade and use in construction. All materials used should be new, comply with applicable standards or technical approvals and have documents such as: certificates, statements of compliance or certificates.
4. The Contractor is obliged to comply with applicable health and safety regulations and fire protection and secure the work area for the entire duration of the work until the final acceptance of the work.
5. The detailed scope of the subject of the contract and the conditions for the implementation of the investment (for both parts of the contract) are defined, in addition to the SWZ, by the following documents:
a) Functional-Utility Program (PFU) (Annex 12 to SWZ);
b) Draft contract provisions (Annex 2a and 2b to SWZ);
c) Contractor's offer with attachments,
d) Explanations to the SWZ (if applicable).
6. NOTE: All contents indicated in the Functional-Utility Program constitute the starting and auxiliary material for the Contractor to prepare its own execution developments for individual tasks, which together create the subject of the contract. In the event of discrepancies in solutions presented by the Contracting Authority and those developed by the Contractor, the Contractor will not claim rights to additional remuneration.
7. The Contracting Authority requires the Contractor to provide a quality warranty and guarantee for defects on the completed subject of the contract for a minimum period of 72 months (applicable to Part I and II). NOTE: The warranty and guarantee period for defects on the completed subject of the contract constitutes a criterion for evaluating offers (applicable to Part I and II). At the same time, the Contracting Authority requires warranty periods for the installed equipment and installations in accordance with the description contained in the PFU. If the warranty period granted by the manufacturer of the device or installation is longer than the periods specified in the PFU, the manufacturer's warranty period shall apply.
LOT-0002
Part II – Supply and installation of solar collectors in a design and build mode.
Part II of the contract covers the supply and installation of solar collectors under the design and build formula:
1) Development of comprehensive, multi-discipline project documentation, covering all works defined in the functional and utility program regarding the supply and installation of solar collectors for domestic hot water (DHW) needs producing thermal energy with 200 l or 300 l DHW tanks in individual households, development of as-built documentation, obtaining required legal opinions, decisions, agreements, permits, and notifications,
2) Execution of works specified in the functional and utility program regarding the supply and installation of solar collectors, and performing author supervision over the investment realization.
3) The Contractor shall be obliged to carry out all works, services, and inspections that ensure the validity of the warranty for the individual devices/elements of the subject of the order – in accordance with the guidelines established by the manufacturer of the devices/elements of the installation in this regard – throughout the warranty period, according to the offer submitted during the proceedings.
4) The equipment and construction products used by the Contractor must:
– be brand new, no older than 2025,
– have an operating and usage manual in Polish,
– have a written warranty from the manufacturer or Contractor regarding quality,
– be placed on the market in accordance with the provisions of the Act of April 13, 2016 on the assessment and market supervision systems (Journal of Laws of 2025, item 568),
– have a declaration of conformity with the provisions defined in community harmonization legislation and the provisions of the European Parliament and Council Regulation (EU) No 305/2011 of March 9, 2011 establishing harmonized conditions for the marketing of construction products and repealing Council Directive 89/106/EEC - CE marking or have a national declaration of performance issued under the provisions of the Act of April 16, 2004 on construction products (Journal of Laws of 2021, item 1213) - marking “B”,
– other requirements for solar collectors are defined in the functional and utility program.
Note:
1. The Ordering Party requires the execution of the subject of the contract in two stages, namely:
Stage I covering residential buildings and properties of residents
Stage II covering public utility buildings.
2. The Ordering Party informs that before starting installation works, the project documentation will require approval respectively by the resident, the Ordering Party, and the Marshal's Office of the Greater Poland Voivodeship. Approval of the documentation does not exempt the Contractor from liability for defects and faults of the subject of the contract.

To implement the task, the Contractor is obliged at its own expense to provide materials, machines, and equipment necessary for its execution, and perform all accompanying works, tasks, and activities necessary to carry out the order. The supplied materials must meet the requirements of products allowed for marketing and use in construction. All materials used must be new, comply with applicable standards or technical approvals and must have documents such as: attest, certificate, or compliance certificate.
2. The Contractor is obliged to comply with current health and safety regulations and fire protection, and to secure the area of the works and operations throughout the entire period of their execution until the final acceptance of the works.
3. The detailed scope of the subject of the order and the conditions for the implementation of the investment (for both parts of the contract) are defined, in addition to the terms of reference, by the following documents:
a) Functional and Utility Program “PUF” (attachment no. 12 to the terms of reference);
b) Draft provisions of the contract (attachment no. 2a and 2b to the terms of reference);
c) The Contractor's offer along with attachments,
d) Explanations to the terms of reference (if applicable).
4. NOTE: All contents indicated in the Functional and Utility Program serve as preliminary and auxiliary material for the Contractor to prepare its own execution developments of individual tasks, which together form the subject of the order. In the event of discrepancies in the solutions presented by the Ordering Party and those developed by the Contractor, the Contractor will not claim rights to additional remuneration.
5. The Ordering Party requires the Contractor to provide guarantees of quality and liability for defects on the executed subject of the order - for a minimum period of 72 months (applies to parts I and II). NOTE: the period of quality guarantee and liability for defects on the executed subject of the order is a criterion for evaluating bids (applies to parts I and II). At the same time, the Ordering Party requires warranty periods for installed devices and installations according to the description contained in the functional and utility program. If the warranty period provided by the manufacturer of the device or installation is longer than the periods indicated in the PUF, the manufacturer's warranty period shall apply.
