The framework agreement aims to provide drones and their accessories as well as any associated services to meet the needs of armed and security forces. The drones included in the scope of the framework agreement are lightweight drones (weighing less than 25 kg) available off-the-shelf (COTS – Commercial off-the-Shelf) and compliant with applicable European regulations. They mainly correspond to classes C0 to C6 according to the EASA classification (European Union Aviation Safety Agency). The main services to be provided are as follows: - the supply of drones, accessories, equipment, and components, - associated services such as training on handling drones, diagnostic services, maintenance, specific technical assistance, - the establishment and management of a dedicated e-commerce site for orders, - the implementation of a solution on the e-commerce site allowing payment by level 3 purchasing card (Decree No. 2023-209 of March 27, 2023, regarding public spending execution via purchasing card), - the provision of all technical documentation (manuals, user guides, etc.) as well as updates (software and documentation updates), - user advice for orders and assistance in equipment implementation, - a service for monitoring and advising on technical and operational developments in the global drone market, - the management of complaints and warranty claims. This is a defense or security market. This draft framework agreement is subject to the negotiated procedure in accordance with the provisions of Articles L. 2324-1, L. 2324-3, R. 2324-1, R. 2324-3, R. 2361-1, R. 2361-8 to R. 2361-12 of the Public Procurement Code. According to Articles R. 2362-1 to R. 2362-8 of the Public Procurement Code, this is a framework agreement with subsequent markets and purchase orders. Under Articles R. 2372-19 to R. 2372-21 of the Public Procurement Code, subsequent contracts that may present significant technical uncertainties may include a portion of supplies or services that could not be precisely defined in the initial public procurement. The maximum recorded in section 2.1.3 and 5.1.5 corresponds to the maximum contractual volume of the services to be performed and beyond which the framework agreement must end. It is specified that the deadline indicated in section 5.1.12 is that of Paris.
