The determination of the subject of the procurement was made considering the provisions of § 46 (3) of Government Decree 321/2015. The contracting authority accepts performance equivalent to the specified products (and brands). In case of doubt, the proof of equivalence lies with the tenderer. The contracting authority draws the attention of tenderers to the fact that the technical description - if justified by the subject of the contract and/or required by legislation - may refer to specific brand-name products or origin, or specific procedures characterizing the products or services offered by a particular economic operator, or trademarks, patents, activities, persons, types, or specific origins or manufacturing processes. Such references may only occur in exceptional cases when it is not possible to provide a sufficiently precise and comprehensible description of the subject of the contract. In such cases, the term “or equivalent” must also be understood in every instance of such designation, meaning that the contracting authority will also accept performance/tender equivalent to the specified type; however, in this case, the tenderer must demonstrate the deviation and the existence of equivalence supported by technical documentation in their offer. Regarding the parameters provided in the technical documentation, the contracting authority will also accept offers that possess properties identical to or better than the indicated functional parameters.
