Electric Energy Storage Facility (EES) with a minimum capacity of 39 MW The subject of the contract is the execution of all necessary activities under the "design and build" formula regarding the design, agreement, and performance of all works, including construction and assembly, electrical, telecommunication, sanitary works, as well as the supply of materials necessary for the proper execution and operation of the Electric Energy Storage Facility with a capacity not less than 39 MW and storage capacity not less than 165 MWh (hereinafter: "EES") including medium/low voltage connections and necessary accompanying infrastructure, for the purpose of power output to the grid of the relevant Distribution System Operator (DSO) in accordance with the Connection Conditions and requirements of the Distribution System Operator (DSO), as well as obtaining all required permits necessary for the proper use of the EES by the Contracting Authority and providing warranty and service services during the warranty period.

Due to limitations of the Competitiveness Database related to the inability to add the correct operational program, the Contracting Authority informs that the entry added in BK is only a technical solution. The project is implemented under the priority program No. 1.15 "Energy Transformation: Electric Energy Storage and Associated Infrastructure for Improving the Stability of the Polish Power Grid." This program is implemented by the National Fund for Environmental Protection and Water Management (NFOŚiGW) and financed from the Modernisation Fund.
UPDATE 29.09.2026 The Contracting Authority made changes in: • Request for Proposal section XI.5 from “* the guaranteed RTE efficiency will be calculated separately for each part of the EES according to the connection point at stations S-41 and S-42” to “* the guaranteed RTE efficiency will be calculated separately for each part of the EES according to the connection point at stations S-41 and S-42, excluding energy consumption for overall EES facility’s own use. The AC-AC RTE measurement should refer to a standard ambient temperature of 25°C”; • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor – in Table 1. Offered storage units in point 1 changed from “Usable capacity” to “Rated capacity”; • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor – in Table 3. Offered low voltage to medium voltage power transformers in point 1 changed from “Transformer power: up to 4.5 MVA” to “Transformer power: up to 4.5 MVA or higher provided the other requirements specified in the Request for Proposal documentation are met and demonstrating that using a higher transformer power will not negatively affect the parameters and safety of the installation operation”; • Attachment No. 2 – Functional and Utility Program – according to point XIV.3 of the Request for Proposal, the list of changes was published on the server containing documentation constituting commercial secrecy and is available to Bidders who have submitted a signed Confidentiality Statement. Due to the above, the Contracting Authority extended the deadline for submission of offers to 28.10.2026.
UPDATE 05.10.2026 The Contracting Authority made changes in: • Request for Proposal section VII.3 from “Planned contract conclusion date: 10/2026” to “Planned contract conclusion date: 11/2026”; • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor – document designation changed from “Attachment No. 1 to Request for Proposal No. 1/2026” to “Attachment No. 1A to Request for Proposal No. 1/2026”; • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor – in Table 2. Offered bidirectional converters PCS in point 1 changed from “Maximum rated power of inverter: 150 kW” to “Maximum loss of available power due to failure of a single inverter or its module, including protection consequences: 1100 kW,” point 2 from “Maximum THD distortion factor: 1.5%” to “Maximum THD distortion factor at rated power, for charging and discharging: 8%” and adding point 3: "Maximum THD distortion factor of current measured on the 6kV side at each connection point of the EES line to switchboards S-41 and S-42, in each phase at rated power of the given line, for charging and discharging (using appropriate filtering systems): 3%," simultaneously updating row numbering; • Attachment No. 2 – Functional and Utility Program – per point XIV.3 of the Request for Proposal, list of changes published on the server containing confidential documentation and available to Bidders who submitted signed Confidentiality Statement; • Attachment No. 6 – Contract Template with the Contractor in §7 ADVANCES AND PARTIAL PAYMENTS by adding clause 3: "Detailed rules and conditions for advance payments are specified in Attachment No. 14 to the Contract taking into account the following requirements: a) advance payment is single and may be made up to a maximum of 20% of the remuneration value; b) advance payment may only be used by the Contractor to cover costs related to contract execution; c) condition for advance payment is submission by the Contractor of an unconditional, irrevocable, and payable on first demand bank or insurance guarantee issued for an amount not less than the advance payment value; d) the content of the insurance or bank guarantee must be previously accepted by the Contracting Authority; e) settlement of advance payment will be made by crediting it against the Contractor’s remuneration", while simultaneously updating numbering of paragraphs in §7. Due to the above, the Contracting Authority extended the deadline for submission of offers to 30.10.2026.
UPDATE 12.10.2026 The Contracting Authority made changes in: • Attachment No. 1A – Minimum device parameters to be confirmed by the Contractor – in Table 1. Offered storage units removing point 4 “Total rated apparent power of PCS converters at least 50 MVA,” simultaneously updating row numbering; • Attachment No. 2 – Functional and Utility Program – as per point XIV.3 of the Request for Proposal, list of changes published on the server with confidential documentation and accessible to Bidders who submitted signed Confidentiality Statement. Due to the above, the Contracting Authority extended the deadline for submission of offers to 02.11.2026.

Conditions for participation: - Knowledge and experience: A Bidder may apply for the contract if they have the necessary knowledge and experience to carry out the contract, including in the last 5 years, or if the business activity period is shorter – then during that period: a) has properly completed at least 4 EPC contracts with a total value of at least PLN 10,000,000.00 (in words: ten million Polish zlotys) net, under which installations with energy storage have been built, including at least one contract worth at least PLN 6,000,000.00 (in words: six million Polish zlotys) net, under which: - a container energy storage with a capacity of at least 0.5 MW and a storage capacity of at least 2 MWh equipped with an electric energy management system was built, AND - telemechanics design was prepared and agreed with DSO, AND - participated in the process of obtaining the permit to use and concession for storing and feeding electricity into the distribution network granted by the President of the Energy Regulatory Office
or has properly completed at least 3 EPC contracts with a total value of at least PLN 25,000,000.00 (in words: twenty-five million Polish zlotys) net, under which installations with energy generation modules have been built, including at least one contract worth at least PLN 10,000,000.00 (in words: ten million Polish zlotys) net, under which: - integration with a plant network within an operational industrial or production plant was carried out, AND - modernization or replacement of medium voltage switchgear, busbars, low voltage switchgear with commissioning was performed, AND - telemechanics design was prepared and agreed with DSO.
b) has properly completed at least 1 EPC contract worth at least PLN 5,000,000.00 (in words: five million Polish zlotys) net, under which construction works in the structural and construction domain were performed; c) has provided at least 1 service of warranty and maintenance for an energy storage of no less than 0.5 MW capacity and no less than 2 MWh storage capacity for at least 12 months.
The conditions specified in points a), b), and c) must be met cumulatively.
NOTE: For the purposes of this proceeding, execution of the contract in the EPC formula (Engineering, Procurement, Construction) is understood as a comprehensive realization of the investment by one entity, including at least: - delivery and/or purchase of devices and materials, - execution of works and/or assembly, - commissioning and/or start-up, - testing, - handover for operation, with the Contractor bearing full contractual responsibility for the above scope (including subcontractors if involved).
NOTE: If the value is stated in a currency other than PLN, the amount will be converted to PLN currency at the average exchange rate of that currency published by the National Bank of Poland on the date of publication of the Request for Proposal.
Method of verifying conditions: Verification will be based on: • the Bidder’s statement on meeting participation conditions in the proceedings, included in Attachment No. 1 to this Request for Proposal – Offer Form, • list of completed contracts according to the template specified in Attachment No. 1 to this Request for Proposal – Offer Form, • evidence confirming proper execution of the indicated contracts and services. In the list: final acceptance protocols, references, declarations along with a copy of the invoice or other documents confirming proper execution of the contract issued by the entity for which the contracts were executed, clearly confirming the scope of the contract, the completion date, and the entity for which the contract was performed. - Technical potential: A Bidder may apply for the contract who has the appropriate technical facilities, infrastructure, and certification allowing for the proper execution of the contract, including having implemented and maintained systems in accordance with the following standards: a) quality management compliant with ISO 9001 or equivalent, b) environmental management compliant with ISO 14001 or equivalent, c) information security compliant with ISO 27001 or equivalent.
Assessment method of the condition: Verification will be based on: • the Bidder's statement on meeting the terms of participation in the procedure, included in Annex No. 1 to the request for quotation – Offer Form, • valid (as of the deadline for submitting offers) certificates issued by an independent, accredited certification body confirming the operation of the required systems. - Persons capable of performing the contract: A Bidder may apply for the contract who possesses and/or will have on the Agreement signing date a team with rights, qualifications and experience necessary for proper execution of the contract, which will be assigned to performing the contract, consisting at least of: • site manager, having collectively: construction licenses to manage construction works without restrictions in structural and construction specialty; at least 2 years of experience managing construction works as site manager or construction manager, counted from the day of obtaining the rights mentioned above; a valid (for the current year) certificate of membership in the relevant District Chamber of Civil Engineers; current civil liability insurance (OC) required for persons performing independent technical functions in construction.

• specialist in electroenergetic project implementation, possessing collectively: experience in implementing electroenergetic investments concerning medium/low voltage networks, transformer stations, inverters or switchboards – the condition shall be met if the indicated person in the last 5 years before the bid submission deadline participated in at least 1 electroenergetic investment; experience in energy storage technology (LFP) – the condition shall be met if the indicated person in the last 5 years before the bid submission deadline participated in at least 1 investment involving electric energy storage; knowledge of construction and energy regulations – the condition shall be met if the indicated person in the last 5 years before the bid submission deadline participated in at least 1 investment requiring project documentation development, obtaining administrative decisions or conducting investment acceptances; experience in managing technical and formal risks – the condition shall be met if the indicated person in the last 5 years before the bid submission deadline participated in at least 1 investment including the process of obtaining decisions on development conditions, building permits, industry approvals or investment acceptances (WZ, PB, building permit, acceptances).
Assessment method of the condition: Verification will be based on the Bidder's statement on meeting the terms of participation in the procedure, contained in Annex No. 1 to the request for quotation – Offer Form. - Economic and financial situation: A Bidder may apply for the contract who is in an economic and financial situation enabling proper execution of the contract, including: a) having financial resources or creditworthiness totaling at least 15,000,000.00 PLN (in words: fifteen million zlotys), b) in the last financial year achieved net sales revenues of at least 70,000,000.00 PLN (in words: seventy million zlotys), c) has no arrears in payment of taxes or social and health insurance contributions, d) has civil liability insurance related to the conducted activity connected to the contract subject for at least 30,000,000.00 PLN (in words: thirty million zlotys).
Assessment method of the condition: Verification will be based on: • Bidder's statement on meeting conditions of participation in the procedure included in Annex No. 1 to the request for quotation – Offer Form, • bank or cooperative savings and credit union certificate confirming the amount of held funds and/or creditworthiness, issued no earlier than 3 months before the bid submission deadline, • part of the financial statement (profit and loss account), and in case of entities not required to prepare it – other financial documents confirming revenue figures for the indicated period (e.g. proper PIT declaration with confirmation of receipt), • certificates not older than 3 months before the bid submission deadline from the Tax Office and Social Insurance Institution or equivalent documents issued by authorities in the country where the Bidder has its registered office or residence, confirming no arrears in taxes, fees, and social and health insurance premiums. In the case such documents are not issued in a given country, a proper declaration in this respect is acceptable. • copy of the insurance policy or other document confirming civil liability insurance together with confirmation of premium payment (if required). If the paid insurance period ends during the period the Bidder is bound by the submitted offer, the Bidder must additionally declare it will extend the insurance under at least the conditions required by the Request for Quotation.
NOTE: If value is given in a currency other than PLN, the amount will be converted to PLN using the average exchange rate published by the National Bank of Poland on the day of announcement of the request for quotation. - Additional participation conditions: => Entities related personally or by capital to the Contracting Authority are excluded from participation. Capital or personal relations mean mutual connections between the Contracting Authority or persons authorized to incur liabilities on its behalf, or persons performing tasks related to preparation and conducting the contractor selection procedure on behalf of the Contracting Authority and the Bidder, in particular: a) participation as a partner in a civil law partnership or personal company, b) holding at least 10% shares or stocks, unless a lower threshold results from law or other documents related to the project, c) holding a function of a member of supervisory or managing body, proxy, attorney, d) being in marriage, kinship or affinity in a direct line, kinship or affinity in a collateral line to the second degree, or being linked by adoption, guardianship, or cohabitation with the Contractor, his legal substitute or members of the managing or supervisory bodies of the contractors applying for the contract, e) having a legal or factual relationship with the Contracting Authority causing justified doubts as to their impartiality or independence in connection with the procurement procedure.
Verification method of grounds/lack of grounds for exclusion: Verification will be based on the Bidder's statement on meeting participation conditions contained in Annex No. 1 to the request for quotation – Offer Form, and statements of the Contracting Authority and persons performing activities related to preparation and conducting the contractor selection procedure on behalf of the Contracting Authority.

NOTE! The provisions of the above sections apply accordingly to all contractors jointly applying for the contract (consortium members) and to third parties whose resources the Bidder refers to to prove meeting the participation conditions. These entities are obliged to submit required statements confirming the lack of grounds for exclusion from participation. - List of required documents/statements: The offer must include: a) offer form with annexes (in accordance with Annex No. 1 – Offer Form), b) annex 1a with attachments – “Minimum device parameters to be confirmed by the Contractor”, completed and signed by the Bidder, c) statements and documents derived from the chapter CONDITIONS OF PARTICIPATION AND GROUNDS FOR EXCLUSION of this Request for Quotation, d) confirmation of submitting bid bond; e) power of attorney to act on behalf of the Bidder (if applicable), e) excerpt or information from the National Court Register, Central Register and Information on Economic Activity or other appropriate register to confirm that the person acting on behalf of the Bidder is authorized to represent it, unless the Contracting Authority can verify current data using free and publicly available databases, particularly public registers under the Act of February 17, 2005, on informatization of public task-performing entities (consolidated text Journal of Laws of 2020, item 346, as amended). Bidders with registered office or place of residence outside the Republic of Poland must submit document(s) issued in the country of their registered office or place of residence.
