3.1. The subject of the order is the service of purchasing and delivering energy, the service of settling the energy produced in the installations of participants based on the rules of the "old prosumer" and repurchasing the surplus energy produced in the installations of participants based on the rules of the "new prosumer*" during the period from January 1, 2026, to December 31, 2027.
3.2. A detailed description of the subject of the order is included in Annex 2 to the SWZ.
3.3. Acting on the basis of Article 18, paragraph 4 of the PZP, the Ordering Party reserves that the documentation mentioned in point 3.14 OPZ (Annex 2 to the SWZ) is confidential, and Contractors who gain access to it are obliged not to disclose it and not to use it for purposes other than preparing an offer and the potential implementation of this order, under the pain of liability for damages. This documentation is not and will not be publicly posted on the Ordering Party's website. The basis for making this documentation available is submitting a "Request for access to documentation" – Annex No. 8 to the SWZ, which must be prepared in Polish.
3.4. The place of performance of the contract: Krakow and the Małopolskie Voivodeship.
