1. The subject of the proceedings is the conclusion of a framework agreement for the supply of unmanned aerial vehicles (UAVs), hereinafter referred to in the remainder of the Terms of Reference (SWZ) as 'assortment'.
2. A detailed description of the subject of the order is provided in Chapter XIX of the SWZ and attachments no. 5a-5c to the SWZ (corresponding to each task).
3. The Contracting Authority allows the submission of partial offers divided into the following 3 tasks:
1) Task no. 1: Supply of an unmanned aerial vehicle (UAV) intended for observation tasks;
2) Task no. 2: Supply of an unmanned aerial vehicle (UAV) intended for operations in environments with high obstacle density;
3) Task no. 3: Supply of an unmanned aerial vehicle (UAV) with an advanced camera system for conducting professional reconnaissance and surveillance activities.
4. The Contractor will be obliged to: 1) For task no. 1, provide a 24-month warranty and guarantee for the offered assortment, i.e., UAV (including the control station, charger, and transport case), excluding batteries and the FTS system, for which a 12-month warranty and guarantee are provided, calculated from the date of signing the quantitative and qualitative acceptance protocol by the Parties. 2) For tasks no. 2 and 3, provide a 24-month warranty and guarantee for the offered assortment, i.e., UAV (including the control station, charger, and transport case), excluding batteries, for which a 12-month warranty and guarantee are provided, calculated from the date of signing the quantitative and qualitative acceptance protocol by the Parties.
5. The Contractor is required to specify in the Offer, in column 3 of the table, the Manufacturer and model or other data clearly identifying the assortment. The term 'Manufacturer' is understood as the company name under which the offered assortment is sold or the entrepreneur introducing the assortment to the market within the territory of the Republic of Poland. If the Contractor does not specify the Manufacturer and model or other data clearly identifying the assortment, the Contracting Authority will reject the offer based on Art. 226.1.5 of the act as inconsistent with the order conditions.
6. The Contracting Authority requires the submission of relevant evidence along with the offer, i.e., a product sheet of the offered assortment containing at least the Manufacturer's name, model, or other data clearly identifying the assortment and technical parameters to confirm:
Task no. 1: a) the range and scope of the laser rangefinder measurement b) the resolution of the thermal imaging camera c) the size of the touch screen in the control station
Task no. 2: a) the resistance of the UAV to dust and water b) the resolution of the thermal imaging camera c) the size and resolution of the touch screen in the control station
Task no. 3: a) the start-up time of the UAV b) the resistance of the UAV to dust and water c) the resolution of the thermal imaging camera d) the resolution of the touch screen in the control apparatus
7. The Contracting Authority accepts equivalent relevant evidence if they confirm that the offered assortment meets the specified requirements. Relevant evidence produced by the Contractor, who is not the Manufacturer, (e.g., the Contractor's own statement) will not be considered equivalent.
8. If the Contractor does not submit relevant evidence or if the relevant evidence is incomplete, the Contracting Authority will request their submission or supplementation within a specified deadline. The Contracting Authority informs that despite the provision for requesting, it will not request the submission or supplementation of relevant evidence if the relevant evidence serves to confirm compliance with features or criteria specified in the description of assessment criteria for offers or if, despite the submission of the relevant evidence, the offer is subject to rejection or there are grounds for annulment of the proceedings.
9. Relevant evidence prepared in a foreign language must be submitted along with a translation into Polish.
10. The type and scope of contract changes are indicated in Chapter XIX of the SWZ.
11. The Contracting Authority allows the entrusting of part of the order's execution to a Subcontractor.
12. The Contracting Authority requires the Contractor to indicate in the offer parts of the order that will be entrusted to Subcontractors and to provide the names of any Subcontractors, if known.
13. Candidates for this order may be Contractors who are not subject to exclusion under Art. 108.1 of the act and Art. 109.1.1, 4, 7, 8, and 10 of the act, and Art. 7.1 of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving the protection of national security (Journal of Laws of 2025, item 514) and Art. 5k of the Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilizing the situation in Ukraine (Official Journal of the EU No L 229 of 31.7.2014, p. 1) as amended, hereinafter referred to as Regulation 833/2014, as amended by Regulation (EU) 2022/576 concerning amendments to Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilizing the situation in Ukraine (Official Journal of the EU No L111 of 8.4.2022, p. 1) and amended by Regulation (EU) 2025/2033 of the Council of 23 October 2025 concerning amendments to Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine.
14. According to Art. 13.1 and 2 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning personal data processing and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as 'GDPR', the Contracting Authority informs that: 1) the administrator of your personal data is the Capital City Police Commander; 2) the data protection officer supervising the proper processing of personal data is: address: ul. 15. The Contracting Authority does not require demonstrating by the Contractor the fulfillment of the conditions specified in Art. 112.2 of the act.
