1. The subject of the contract is the successive delivery by the Contractor to the Contracting Authority of reagent kits for molecular diagnostics of the HPV virus (hereinafter referred to as the goods) detailed and in quantities specified in the Price Form constituting Appendix No. 2 to the SWZ along with the lease of the device (hereinafter interchangeably referred to as the equipment or the object of lease), described in detail in the Statement of Required Functions and Technical Parameters, constituting Appendix No. 6 to the SWZ, and in accordance with the draft provisions of the contract constituting Appendix No. 4 to this SWZ. 2. In the absence of demand for the assortment covered by the subject of the contract, the Contracting Authority reserves the right not to order part of the assortment specified in Appendix No. 2 to the SWZ, subject to section 3. The Contractor shall not have any claims for damages or claims based on other legal grounds, to which the Contractor agrees. 3. The Contracting Authority guarantees that the minimum value of orders granted to the Contractor during the term of the contract will be 60% of the maximum value of the contract specified in § 6 sec. 1 point 1 of Appendix No. 4 to the SWZ. 4. The Contracting Authority has specified in Appendix No. 2 to the SWZ the quality requirements related to at least the main elements constituting the subject of the contract. The Contracting Authority informs that in the ongoing procedure conducted in the mode of an open tender, it provides for the possibility of applying the procedure mentioned in Article 139 sec. 1 of the Public Procurement Law. The Contracting Authority, using the mentioned procedure, will first conduct the examination and evaluation of the offers, and then qualify the subjective Contractor whose offer was rated highest in terms of lack of grounds for exclusion and meeting the participation conditions in the procedure.

The Contractor is obliged to provide in Appendix No. 2 to the SWZ the name of the manufacturer and the trade name or catalog number, net and gross price of the leased device.
