The subject of the order includes the following scope:
- delivery of the subject of the order to the contracting authority's premises
- installation and commissioning of the delivered equipment/device,
- training of the contracting authority's personnel in the operation, cleaning, disinfection, and maintenance of the delivered subject of the order,
- training of the imaging diagnostics facility personnel in the performance of examinations,
- delivery of required documents (in accordance with the provisions of the contract).
The detailed description of the subject of the order is indicated in Annex No. 2 - Technical specifications.
The contracting authority requires that the delivered subject of the order meets the requirements specified in the Act of April 7, 2022, on medical devices (Journal of Laws of 2024, item 1620, as amended), the Act of November 29, 2000, Atomic Law (consolidated text Journal of Laws of 2026, item 1), Regulation of the Minister of Health of January 11, 2023, on the conditions for the safe use of ionizing radiation for all types of medical exposure (consolidated text Journal of Laws of 2025, item 1288), as well as other requirements specified in other applicable special provisions and standards concerning the subject of the order and meets the minimum requirements specified in the SWZ. The contractor must have documents confirming the above and is obliged to provide them to the contracting authority upon request and at any time - if applicable.
The contracting authority requires that the subject of the order be new, free from physical and legal defects, and factory packaged, produced no earlier than in 2025.
The contracting authority allows equivalent solutions. An equivalent solution is understood as the use of a parameter different from that described, while maintaining the technical, quality, usability, or functional parameters referred to in the SWZ. The offered device with equivalent parameters must be authorized for use in accordance with applicable law.
The contracting authority reserves that the proposed equivalent solution cannot have lower quality characteristics than the parameters required by the Contracting Authority in the Specification of the Terms of Order. The contracting authority reserves that if the contractor proposes a subject of the order other than that specified by the contracting authority (equivalent), they are obliged (for comparative purposes) to present the contracting authority with appropriate documentation, which will include, in particular, the parameters of the proposed subject of the order.
It is anticipated that the procurement procedure may be annulled in the event of non-allocation of funds that the contracting authority intended to allocate for the financing of the entire or part of the order.
