The subject of the contract is the design, construction, and commissioning of a photovoltaic power plant with a capacity of up to 120 kW with an energy storage system of 100 kWh, energy outflow blockage to the grid, together with connection to the electrical grid and obtaining the formal and legal documentation required by applicable laws necessary for the commissioning and operation of the installation. The photovoltaic power plant will be located in Pyskowice at Piaskowa Street 5. The task is to be executed in a design-and-build formula. 2. A detailed description of the subject of the contract constitutes Annex 7 to the SWZ – Functional and Utility Program. 3. The order is divided into a design part and an execution part, and the conditions for the execution of the order are detailed in Annex 8 to the SWZ - the draft provisions of the contract. 3. The task is co-financed within the program: European Funds for Silesia 2021 -2027 Fund for Just Transition Priority FE SL in action 10.06 “Development of decentralized energy based on renewable energy sources”. 4. In cases where the Ordering Party refers to standards, technical assessments, technical specifications, and reference systems mentioned in Article 101 paragraph 1 point 2 and paragraph 3 of the Act while describing the subject of the order, the Ordering Party informs that in such cases it allows equivalent solutions described in each such standard, European technical assessment, approval, technical specification, reference system. 5. Employment requirements based on an employment contract – in accordance with Article 95 of the Act: The Ordering Party requires employment based on an employment contract by the Contractor, subcontractor, or further subcontractor for physical construction workers performing the below-mentioned activities necessary to execute the order: earthworks, installation of photovoltaic systems, and site development and management works. 6. Control of the Contractor’s compliance with the requirements related to employing these persons and the sanctions for non-compliance with these requirements are detailed in paragraph 4 of the draft provisions of the contract – Annex 8 to the SWZ. 7. Information regarding the site visit: 7.1. The site visit is not mandatory, which means that the lack of a visit does not constitute grounds for rejecting the offer. 7.2. Rules for conducting the site visit: 7.2.1. The site visit will be conducted on the date indicated by the Ordering Party and will take place at the location of the order constituting the subject of this procedure. 7.2.2. Interested Contractors must submit a request to schedule the site visit and a confidentiality statement (Annex 5 to the SWZ) in electronic form with a qualified electronic signature in accordance with the representation or granted authorization, via the Platform. 7.2.3. The request must be submitted no later than August 12, 2025. The date of submission to the Ordering Party is decisive. The Ordering Party reserves the right to change the aforementioned date by possibly extending it. 7.2.4. In response to the request mentioned in point 7.2.2 above, the Ordering Party will inform Contractors about the date of the site visit. Site visit requests submitted after the deadline specified in point 7.2.3 above will not be considered by the Ordering Party. 7.2.5. No additional information will be provided during the site visit, nor will answers be given to questions asked by Contractors. Any queries should be submitted under Article 135 of the Act, according to the rules specified in Chapter XVII of the SWZ via the Platform. 7.2.6. A person designated by the Ordering Party, who will assist Contractors during the site visit, will inform about instances where there may be a prohibition on photographing and recording sound and image. 7.2.7. Information obtained during the visit regarding the Ordering Party’s infrastructure is confidential. 7.2.8. The costs associated with participating in the site visit, particularly related to travel, are borne solely by the Contractor. 7.3. The fact of conducting the site visit will be documented with a attendance list, which will be prepared during the visit, at the place where it is conducted.
