1.1. The subject of the contract is the design, delivery, and installation of photovoltaic installations with a total power of at least 165.545 kWp for the following facilities:
1.1.1. Sewage treatment plant in Sierakowice (Leśna St., 44-156 Sierakowice);
1.1.2. Sewage treatment plant in Trachy (Raciborska St. 78, 44-153 Trachy);
1.1.3. Water treatment station in Rachowice (Do Groty St., 44-156 Rachowice);
1.1.4. Water treatment station in Sierakowice (Kozielska St., 44-156 Sierakowice);
1.1.5. Water treatment station in Sośnicowice (Św. Jakuba St., 44-153 Sośnicowice).
1.2. The contract also includes services (design work), deliveries (supply of equipment), and construction work (installation work), whereby the main service in the present factual state is the supplies.
1.3. The subject of the contract and the conditions for its implementation are detailed as follows:
1.3.1. functional and utility program (PFU);
1.3.2. draft contract provisions.
1.4. The list of materials in the functional and utility program serves only an auxiliary function and is not binding for the valuation of the contract.
1.5. If trademark indications, patents, origins, sources, or special processes characterizing products, materials, solutions, or services delivered by a specific contractor, manufacturer, or standards and other references mentioned in Article 101(1)(2) or (3) of the Act are included in the contract documents, they should be treated as examples, and the Ordering Party allows for the offering of equivalent materials or solutions. Equivalent materials, devices, or solutions are those with parameters no worse than the required ones, and if minimum parameters have not been specified, this means materials, devices, or solutions with similar parameters suitable for the requested application, including in terms of identity of function, type and quality of materials, and technical data.
1.6. The Ordering Party does not allow the submission of partial offers for the reasons specified below. This order is awarded in parts, each of which constitutes the subject of a separate procurement procedure. Each part is characterized by a comprehensive scope of execution in the design and build formula. Allowing for the submission of partial offers would threaten excessive technical and organizational difficulties resulting from the dispersion of the Contractor's responsibility for both its performance and after-sales service (warranty and service). It could also lead to significant differences in the standard and quality of services, supplies, and construction works for various facilities of the Ordering Party. It should also be taken into account that the subject contract has a certain degree of repeatability, which facilitates its execution and allows costs to be reduced when it is not excessively diversified. Allowing for the submission of partial offers would not affect increasing competitiveness (including increasing access for the SME sector), as this is a small-scale contract that can be executed by the same circle of Contractors from the SME sector as the individual elements of the order. At the same time, the lack of allowing the submission of partial offers does not affect the limitation of competition, nor does it constitute non-compliance with the provisions of the Pzp Act.
3.8. The Ordering Party does not require the submission of subject evidence along with the offer. The method of verifying compliance with the required parameter mentioned in the technical specifications in the PFU refers to the stage of contract implementation.
3.9. The Ordering Party does not allow for the submission of variant offers.
3.10. The Contractor may entrust the execution of a part of the order to a subcontractor.
3.11. According to Article 5k of Council Regulation (EU) No. 833/2014 of July 31, 2014, regarding restricting measures in connection with actions by Russia destabilizing the situation in Ukraine, the execution of the public procurement is prohibited with the participation of subcontractors, suppliers, or entities whose capacity is relied upon within the meaning of Directive 2014/24/EU, when they account for more than 10% of the value of the order.
3.12. The Ordering Party does not reserve the obligation for the Contractor to personally perform key tasks.
