1. The subject of the order is the Delivery of a Mobile Field.
2. A detailed description of the subject of the order can be found in Part II of the SWZ Description of the Subject of the Order.
3. In all cases where the Contracting Authority describes the subject of the order by referring to standards, technical evaluation, technical specifications, and reference technical systems referred to in Article 101(1)(2) and (3) of the Act, the Contracting Authority allows equivalent solutions if they allow achieving characteristics or parameters no worse than those indicated. This means that the contractor can use solutions described by the Contracting Authority "or equivalent".
4. According to Article 101(5) of the Act, the Contractor who refers to equivalent solutions described by the Contracting Authority is obliged to demonstrate that the supplies offered by him meet the requirements specified by the Contracting Authority, provided that the Contractor proves in the offer, in particular using the evidence referred to in Articles 104-107 of the Act, that the proposed solutions satisfactorily meet the requirements specified in the description of the subject of the order.
5. The Contracting Authority will reject the offer based on Article 393(1)(4) of the Act, in which the share of products, including software used in telecommunications networks coming from member states of the European Union, states with which the European Union has entered into agreements on equal treatment of entrepreneurs, or states to which the provisions of directive 2014/25/EU apply under a Council decision, does not exceed 50%.
6. Currently, the subject of this order is not co-financed from EU funds. The Contracting Authority does not exclude that the subject of the Agreement may be part of a project that will be eligible for funding from EU funds (e.g. from the National Reconstruction Plan, European Funds for Infrastructure, Climate, Environment 2021-2027, Modernization Fund, Defense and Security Fund). A detailed description of the requirements has been described in Part IV of the SWZ Agreement.
7. The Contracting Authority informs that before the commencement of this proceeding, it conducted Preliminary Market Consultations.
