1. The subject of the order is the preparation of design and construction documentation and the execution of construction and installation works in a design-build formula, based on which the construction can be formally-legally and technically realized and the execution of works in accordance with this project documentation is possible, divided into two Parts of the order for the scopes:
1.1. Part 1 - construction of a medium voltage 15kV cable connection for powering a public charging station for vehicles in Gdańsk at Lubowidzka Street 33, divided into Stages:
1.1.1. Stage I – preparation of construction and execution project documentation, also referred to as "Project Documentation";
1.1.2. Stage II – execution of construction-installation works, including in particular:
1) construction of a medium voltage 15kV cable connection with a length of approx. L=90m,
2) construction of a grey paving stone band of 8 cm thickness with a total area of approx. 9m2,
3) execution of grey concrete edges with dimensions 8x30x100cm with a total length of approx. 12m,
4) execution of a surface from a permeable layer, e.g., geogrid with a total area of approx. 5m2,
5) installation of a radio-controlled 3-pole cable connection ZKSN-15kV in a two line field + one circuit breaker field system,
6) execution of grounding.
1.2. Part 2 - construction of a medium voltage 15kV cable connection for powering a public charging station for vehicles in Kowale at Energetyczna Street 17,
1.2.1. Stage I – preparation of construction and execution project documentation, also referred to as "Project Documentation";
1.2.2. Stage II - execution of construction-installation works, including in particular:
1) construction of a medium voltage 15kV cable connection with a length of approx. L=30m,
2) construction of a grey paving stone band of 8 cm thickness with a total area of approx. 4m2,
3) execution of grey concrete edge with dimensions 8x30x100cm with a total length of approx. 25m,
4) execution of a surface from a permeable layer, e.g., geogrid with a total area of approx. 98m2,
5) execution of a point lowering of the concrete curb with a length of L=12m,
6) reconstruction of existing fencing at the location of the cable connection,
7) installation of a radio-controlled 3-pole cable connection ZKSN-15kV in a two line field + one circuit breaker field system,
8) execution of grounding.
2. Detailed description of the order's subject is contained within:
2.1. Part 1: functional-utility program with supplementary information (jointly referred to as the functional-utility program or "PFU") constituting appendix no. 14 a to SWZ.
2.2. Part 2: functional-utility program with supplementary information (jointly referred to as the functional-utility program or "PFU") constituting appendix no. 14 b to SWZ.
The Contracting Authority requires that the order subject in each Part of the order be executed according to the guidelines indicated in this documentation (appendix no. 17 to SWZ) and instructions and standards constituting appendices to SWZ (appendix no. 18 to SWZ) and the designed contract terms (appendix no. 15 to SWZ). The designed contract terms are the same for each Part of the order.
3. The Contracting Authority requires that:
3.1. the execution of the order subject be carried out exclusively using (regardless of its method or scope) software, materials, products, or devices originating from:
3.1.1. countries of the European Union;
3.1.2. third countries being parties to the World Trade Organization Agreement on Government Procurement or other international agreements to which the European Union is a party, guaranteeing market access to public procurement on the basis of reciprocity and equality, with the place of origin determined in accordance with Article 60(1) and (2) of the Regulation of the European Parliament and of the Council (EU) No 952/2013 of October 9, 2013, establishing the customs code.
3.2. The execution of the order subject did not include:
3.2.1. any ICT product, ICT service, or ICT process identified in the recommendation by the Government Plenipotentiary for Cybersecurity issued based on Article 33(4) of the Act of July 5, 2018, on the national cybersecurity system, confirming a negative impact of such ICT products, services, or processes on the basic interest of national security (Article 226(1)(17) of the Public Procurement Law); and
3.2.2. any ICT product whose type was specified in the decision of the minister relevant to matters of informatisation acknowledging a provider as a high-risk supplier, issued based on Article 67b(15) of the Act of July 5, 2018, on the national cybersecurity system, nor any ICT service or ICT process specified in such a decision (Article 226(1)(19) of the Public Procurement Law).
By "ICT product", "ICT service", and "ICT process" are meant the respective product, service, and process referred to in Article 2(12)–(14) of Regulation (EU) 2019/881 of the European Parliament and of the Council of April 17, 2019, on ENISA (the EU Agency for Cybersecurity) and cybersecurity certification regarding information and communication technologies, and repealing Regulation (EU) No 526/2013 (the Cybersecurity Act), under the understanding of the Act of July 5, 2018, on the national cybersecurity system.
4. The Contracting Authority allows the submission of partial offers. The Contractor may submit an offer for any number of parts.
5. The Contractor will grant the Contracting Authority a warranty under the conditions described in the contract terms.
6. The Contracting Authority anticipates the possibility of canceling the procurement procedure if the public funds intended for financing the entirety or part of the order have not been allocated (Article 257 of the PPL Act).
7. The procedure is being conducted considering the provisions applicable to procurement with a value equal to or greater than the EU thresholds specified in Article 3(1)(1) of the PPL Act.

1. The subject of the order is the execution of construction and design documentation as well as construction and installation works in the design-build formula, based on which the construction will be possible in both formal-legal and technical terms, and the execution of works in accordance with this project documentation for the scope:
Part 2 - construction of a medium voltage 15 kV cable connection for the supply of a public vehicle charging station in Kowale, Energetyczna Street 17.
2.1. Stage I – preparation of construction-execution design documentation, also known as "Project Documentation,"
2.2. Stage II - execution of construction and installation works, including in particular:
1) construction of a medium voltage 15 kV cable connection approximately L=30m long,
2) construction of a gray paving block band with a thickness of 8 cm with a total area of approximately 4m2,
3) execution of a gray concrete edging measuring 8x30x100cm with a total length of approximately 25m,
4) execution of a permeable surface layer such as Geo Grid with a total area of approximately 98m2,
5) execution of a point lowering of the concrete curb to a length of L=12m,
6) reconstruction of the existing fence at the cable connection location,
7) installation of a cable connection ZKSN-15kV 3-field remotely controlled in two line fields + one disconnection field arrangement,

2. The detailed description of the subject of the order is contained in the functional-utility program along with supplementary information (hereinafter jointly as the "functional-utility program" or "PFU") constituting Annex 14 b to SWZ.
The contracting authority requires that the subject of the order in each Part of the order is executed in accordance with the guidelines indicated in this documentation (Annex 17 to SWZ) and instructions, and standards constituting an annex to SWZ (Annex 18 to SWZ) and the draft contract provisions (Annex 15 to SWZ). The draft contract provisions are the same for each Part of the order.
3. The contracting authority requires that:
3.1. the execution of the subject of the order is carried out solely using (regardless of its method or scope) software, materials, products, or devices that originate from:
3.1.1. EU member states or
3.1.2. third countries that are parties to the Agreement of the World Trade Organization on Government Procurement or other international agreements to which the European Union is a party, guaranteeing mutual and equal access to the public procurement market, with the determination of origin following art. 60 sec. 1 and 2 of the Regulation (EU) No 952/2013 of the European Parliament and of the Council dated 9 October 2013 establishing the customs code.
3.2. the execution of the subject of the order did not include:
3.2.1. any ICT product, ICT service, or ICT process, which is indicated in the recommendation of the Government Plenipotentiary for Cybersecurity Affairs, issued based on art. 33 sec. 4 of the Act of 5 July 2018 on the national cybersecurity system, stating the negative impact of such ICT products, services, or processes on the fundamental interest of state security (art. 226 sec. 1 point 17 of the Public Procurement Law) and
3.2.2. any ICT product, whose type is defined in the decision of the minister responsible for computerization recognizing the supplier as a high-risk supplier, issued based on art. 67b sec. 15 of the Act of 5 July 2018 on the national cybersecurity system, nor any ICT service or process specified in such a decision (art. 226 sec. 1 point 19 of the Public Procurement Law).
By "ICT product," "ICT service," and "ICT process" means respectively the product, service, and process referred to in art. 2 points 12–14 of Regulation (EU) 2019/881 of the European Parliament and of the Council of 17 April 2019 on ENISA (the EU Agency for Cybersecurity) and cybersecurity certification of information and communication technologies and repealing Regulation (EU) No 526/2013 (Cybersecurity Act), within the meaning of the Act of 5 July 2018 on the national cybersecurity system.
