I. The subject of the order in this procedure is: 1) the production and delivery of 6 pieces of factory new, single-brand, low-floor, solo, eco-friendly maxi-class city buses powered by electricity, intended for use in public transport in the City of Siedlce and suburban lines equipped with a range of solutions improving the usability of public transport and passenger safety, as well as adapted to the needs of persons with disabilities, referred to in the content of the SWZ as "buses"; the order also includes the authorization and equipping of the technical background of the public transport operator in Siedlce - Siedlce Municipal Transport Company Sp. z o.o. (referred to in the content of the SWZ as "Transport Operator") - with necessary devices allowing for diagnostics and technical repairs of the delivered vehicles; 2) delivery, installation, and commissioning of 4 pieces of brand new, stationary, electric, plug-in chargers, including: a) 1 piece of dual-station charging station with a charging power of 2×60 kW on the premises of the MPK depot at ul. Starzyńskiego 20, 1 piece of dual-station charging station with a charging power of 2×60 kW at ul. Kalinowa; and 2 pieces of single-station with a power of 120 kW each on the premises of the Transfer Center at ul. W. Pileckiego. b) execution of project documentation, installation of internal power supply lines necessary to supply electricity to the bus charging stations on the premises of the MPK depot, at the Transfer Center at ul. W. Pileckiego, at the bus loop at ul. Kalinowa. Obtaining permits and decisions necessary to start the charging stations and obtain technical acceptance. The charging station at the MPK depot does not require the execution of energy connections; in the place of its location, there is a prepared cable connection for the new station, only its connection to the power supply, proper placement, and inclusion in the telemetry system is required. Near the connection at the depot, there is a transformer with an appropriate reserve of connection power; 3) conducting training for the Transport Operator's employees regarding the operation and servicing of electric-powered vehicles, the management of energy storage charging processes in buses, and the operation and supervision of the charging infrastructure, including the use of all delivered components, 4) delivery of technical and operational documentation (instructions, catalogs, diagrams, etc.), presented in the description of the subject of the order, for buses and charging infrastructure, 5) delivery of equipment for the Transport Operator's service station, a set of tools and specialized devices enabling obtaining internal authorization from the manufacturers of buses and charging stations, used for the contracting authority's own needs. The contracting authority reserves the right to conduct a single inspection by three of its representatives during the production/construction/execution of electric buses at their place of production, within a time agreed with the contractor and at the contractor's expense. The contracting authority, in accordance with the requirements resulting from Article 3e of Regulation (EU) 2019/1242 establishing CO2 emission standards for new heavy vehicles and amending European Parliament and Council Regulation (EC) No 595/2009 and (EU) No 2018/956 and Council Directive 96/53/EC (as amended by European Parliament and Council Regulation (EU) 2024/1610 of May 14, 2024, amending Regulation (EU) 2019/1242 regarding the tightening of CO2 emission standards for new heavy vehicles and including reporting obligations, amending Regulation (EU) 2018/858 and repealing Regulation (EU) 2018/956) requires that the contractor: 1) ensures the current availability of spare parts necessary for the functioning of the offered subject of the order, 2) continually assesses the availability of spare parts ensuring the functioning of the offered subject of the order, 3) ensures that any changes in its supply chain during the execution of the order do not negatively affect the execution of the order, 4) ensures such an organization of spare parts availability that meets the security supply requirements, so that even any changes in the supply chain during the execution of the contract will not negatively affect the execution of the contract; defined in Article 7 point 10 of the Pzp Act, supply chain means all resources and activities necessary to carry out the supplies and services that are the subject of the order, additionally, the "supply chain" is not limited solely to direct suppliers but also extends to subcontractors, 5) allowed the purchase of parts for the delivered vehicles necessary for warranty and post-warranty repairs according to the provisions of § 11 sec. 12 of the contract for a period of at least 15 years from the date of final acceptance of the subject of the order. The fulfillment of the contractor's obligations stated in points 1-5 above aims to ensure the continuous proper functioning of the vehicles that are the subject of the contract throughout the planned operational period of at least 15 years. Due to the limited number of characters, the Detailed Description of the subject of the order (OPZ), containing requirements, technical parameters, and equipment that the offered subject of the order must meet and possess, constitutes Attachment No. 7 to the SWZ, and Chapter 5 of the SWZ contains information on the participation of contractors/contractors jointly applying for the award of the contract/entities providing resources/subcontractors/further subcontractors from "third countries that are not parties to international agreements" and specifies less favorable conditions for deliveries from "third countries that are not parties to international agreements".
