The object of the contract includes:
• Acquisition of the Technical Project
• Acquisition of installations/equipment for creating a new capacity for electricity production from renewable solar energy sources, with storage – installed CEF capacity of 6.5 MWp, BESS – 10 MWh and heat pumps of 700 kWt;
• Execution of construction/installation works for putting into operation the electricity production and storage unit and the thermal agent production capacity.
Through this investment project, the applicant S.N. INTERNATIONAL AIRPORT TIMISOARA TRAIAN VUIA S.A. aims to create a new capacity for electricity production from renewable resources, specifically solar energy, with the establishment of a new integrated energy storage capacity (behind the meter), installation of heat pumps.

The estimated value of the design, supply, and execution works contract for the project “PHOTOVOLTAIC PARK 7MW” is 43,674,338.14 lei excluding VAT.
IMPORTANT! The procedure for awarding the public procurement contract is initiated under this suspensive clause, meaning that the conclusion of the public procurement contract is conditioned by the signing of the financing contract. Considering the provisions of Law no. 99/2016 regarding public procurement and HG. no. 394/2016, with subsequent amendments and completions, the contracting authority specifies that it will conclude the contract with the bidder declared the winner only if the financing contract is signed. In the event that, for any reason, the financing contract is not signed, the Contracting Authority reserves the right to cancel the awarding procedure, provided that there is no other funding source, in accordance with the provisions of Law 99/2016 with subsequent amendments and completions, as concluding the public procurement contract becomes impossible. Bidders in this procedure understand that the contracting authority cannot be held responsible for any damages in the event of cancellation of the awarding procedure, regardless of their nature and whether the contracting authority has been notified of the existence of such damages. Bidders in this procedure accept the use of the above special conditions of the suspensive clause, assuming full responsibility for any damages they may suffer in the described situation. We mention that S.N. INTERNATIONAL AIRPORT TIMISOARA “TRAIAN VUIA” S.A., TIMIS COUNTY, GHIRODA LOCATION, AEROPORT STREET, NO. 2 has not signed a financing contract with the Ministry of Transport and Infrastructure. The suspensive clause is proposed as a means to accelerate the implementation of projects to achieve the proposed objectives. The provisions of Art. 1399 and following of the Civil Code apply, namely “the obligation whose effectiveness or annulment depends on a future and uncertain event is affected by a condition” and “the condition is suspensive when the effectiveness of the obligation depends on its fulfillment”. Thus, the suspensive clause is allowed according to common law, and the standard format of the data sheet elaborated by ANAP explicitly mentions the possibility of such clauses at point IILl.4) The execution of the contract is subject to other special conditions. The suspensive clause specifies that the source of financing for the tendered contract is not secured at the time of the tender.
Note: The estimated value of the contract does not include the amount for various unforeseen expenses, as provided in the general estimate, which may be accessed as needed.
