The project aims to support the Federal Ministry for the Environment, Climate Protection, Nature Conservation, and Nuclear Safety (BMUKN) in addressing legal questions in the areas of climate protection, environmental, and energy law. This includes clarifying legal questions in the areas of energy, industry, transport, buildings, waste management, agriculture, land use, land use change, and forestry (LULUCF), as well as considering and dealing with EU law, including state aid law and constitutional legal issues. This also encompasses potential connections to the EU Climate Social Fund.
The project also includes the evaluation of proposals for climate protection regulations and climate protection measures at both the European and national levels. It aims to analyze their consistency with existing national and European legal frameworks, especially the legally established target of greenhouse gas neutrality by 2045.
In about a quarter of the cases, alongside clarifying legal questions, an economic, social, or factual impact analysis is necessary. In about 10% of the cases, significant legal, economic, and social preliminary questions should be worked out for a possible further development of climate protection regulations or measures, as required for legal reasons or based on factual effects.
The project is intended to support the BMUKN in preparing relevant files at the EU level and questions regarding their implementation at the national level, as well as the further development of the national legal framework. The goal is to prepare legal and factual, economic, and social preliminary questions and to substantiate them with empirical data and legal analyses, in order to improve the foundations for effective and sustainable climate protection policy.

Legal Support for the Implementation of the New EU Climate Target and the Development of Climate Protection Law.
The project serves to support the BMUKN within its departmental responsibility. Specifically, the following services are to be provided:
Work Package 1 (WP 1): Assessments related to EU files
WP 1.1: Preparation of legal opinions, background papers, and presentations (potentially including demonstrations via video conference) to clarify preliminary questions for the relevant EU files (15 papers of 10 DIN A4 pages each; in case of an optional extension of the duration: up to 5 further papers of 10 DIN A4 pages each).
WP 1.2: Preparation of short opinions or ad-hoc evaluations to assess regulation and action proposals, strategy papers, or other contributions to the further development of the European climate protection legal framework (short opinions and ad-hoc evaluations: 30 papers with about 5 DIN A4 pages each; in case of an optional extension of the duration: up to 10 further papers of 5 DIN A4 pages each).
Work Package 2 (WP 2): Assessments related to the national implementation of European law and the general development of national law
WP 2.1: Preparation of legal and possibly economic opinions, background papers, and presentations as well as regulatory options for the legal implementation of European requirements in national climate protection, energy, and specialist law and for the general development of the national climate protection-relevant legal framework, including energy law and including associated interactions with other specialist laws, such as those from the emissions protection, circular economy, or planning law, as well as through new climate protection legislative proposals (23 opinions of 10 DIN A4 pages each; in case of an optional extension of the duration: up to 7 further papers of 10 DIN A4 pages each).
WP 2.2: Preparation of short opinions or ad-hoc evaluations to assess regulation and action proposals on the aforementioned topics (20 short opinions with about 5 DIN A4 pages each; in case of an optional extension of the duration: up to 8 further papers of 5 DIN A4 pages each).
The contracting authority shall be able to call off a range of services from the topics mentioned under WP 1 and WP 2 as required (optional). Optional services will be requested individually up to the maximum quantity by the contracting authority. Within each option, the contracting authority reserves the right to only partially call off the described service.

WP 3.1: Opinions
Up to 9 opinions of about 10 DIN A4 pages; to be prepared within 3 weeks after request by the contracting authority; in case of an optional extension of the duration: up to 3 further papers of 10 DIN A4 pages to be prepared within 3 weeks after request.
WP 3.2: Short opinions
Up to 15 short opinions of about 5 DIN A4 pages, to be prepared within 2 weeks after request by the contracting authority; in case of an optional extension of the duration: up to 5 further papers of 5 DIN A4 pages to be prepared within 2 weeks after request.
WP 3.3: Workshops
5 one-day events lasting about 6 hours with approximately 20 participants, excluding travel costs; in case of an optional extension of the duration: one additional one-day event lasting about 6 hours with approximately 20 participants, excluding travel costs. The workshops can bring together participants from various backgrounds. They serve to draw practical perspectives for the joint development of relevant research results.
