1. The subject of the contract is the execution of the task titled "Expansion of the bus depot along with the construction of a workshop and social building and the installation of photovoltaic panels at Sikorski Avenue" in the "design and build" formula, involving the design and construction of infrastructure for the production and self-consumption of electricity based on a PV photovoltaic installation and the expansion of the bus depot at Sikorski Street in Olsztyn.
2. The scope of work covered by the subject of the contract is described in the project documentation developed for the task titled "Expansion of the bus depot regarding the construction of a workshop and social building, expansion of the maneuvering area with new parking positions, and Functional-Utility Program for the task involving the construction of infrastructure for electricity production and self-consumption based on a PV photovoltaic installation and expansion of the bus depot at Sikorski Street in Olsztyn.
3. A detailed description of the subject of the contract, as well as its size and scope, is specified in the Specification of Contract Terms and in the attachments to the SWZ.
4. The contracting authority anticipates the provision of similar contracts as mentioned in Article 214, paragraph 1, point 7 of the Pzp Act, within 3 years from the date of awarding the primary contract. If additional financial resources are available, the contracting authority will grant the contractor, with whom the contract will be signed in this procedure, orders related to the repetition of similar construction works, as provided for in this procurement notice. The contracting authority anticipates providing orders mentioned in Article 214, paragraph 1, point 7 of the Pzp Act, with an estimated value of up to 5,000,000 PLN, which will specifically include the following elements:
1) construction or reconstruction of retaining walls or strengthening embankments,
2) construction or reconstruction of a rectifier station for tram traction,
3) construction and reconstruction of network infrastructure related to the investment,
4) construction or reconstruction of sidewalks or pedestrian-bicycle paths or cycling paths related to the investment,
5) tree felling and green management,
6) execution of new planting or compensatory planting,
7) construction or reconstruction of facilities along with the development of adjacent areas or within the investment area not indicated in the building project.
The aforementioned construction works are similar to the construction works that are the subject of the primary contract, thus, the construction works covered by the similar contract are of a similar nature to the works covered by the primary contract. The scope of works not only shows similarity to the primary contract but is also consistent with its subject. Considering that the execution of construction works covered by the primary contract, as well as the order pursuant to Article 214, paragraph 1, point 7 of the Pzp Act, aims to ensure full functionality of the facility, it should be stated that there is also a functional relationship between them.
5. The stated estimated value of the contract is 41,783,901.98 PLN, which includes the value of the primary contract: 36,783,901.98 PLN and the value of the contract under Article 214, paragraph 1, point 1 of the Pzp Act: 5,000,000.00 PLN.
