Electric Energy Storage Facility (EES) with a minimum power of 39 MW The subject of the order is the implementation of all necessary activities under the "design and build" formula concerning the design, coordination, and execution of all works, including construction and assembly, electrical, telecommunication, sanitary works, as well as deliveries necessary for the correct execution and operation of the Electric Energy Storage Facility with a power of not less than 39 MW and capacity of not less than 165 MWh (hereinafter: "EES"), including MV/LV connections and necessary accompanying infrastructure, for the purpose of delivering power to the network of the appropriate Distribution System Operator (DSO) in accordance with the Connection Conditions and requirements of the Distribution System Operator (DSO), as well as obtaining all required permits necessary for the proper use of the EES by the Contracting Authority and providing warranty and service services during the warranty period.

Due to limitations of the Competitiveness Database related to the inability to add the correct operational program, the Contracting Authority informs that the call added in the Competitiveness Database is only a technical solution. The project is implemented under the priority program no. 1.15 "Energy transformation Electrical energy storage and related infrastructure to improve the stability of the Polish power grid". This program is implemented by the National Fund for Environmental Protection and Water Management (NFOŚiGW) and funded from the Modernization Fund.
UPDATE 29.09.2026 The Contracting Authority has made changes to: • Request for Proposal item XI.5. from "* Guaranteed RTE efficiency will be calculated separately for each part of the EES in accordance with the connection point at stations S-41 and S-42" to "* Guaranteed RTE efficiency will be calculated separately for each part of the EES in accordance with the connection point at stations S-41 and S-42, excluding energy consumption for the overall facility's own needs of the EES. The AC-AC RTE measurement should be referred to a standard ambient temperature of 25°C"; • Attachment No. 1A – Minimum equipment parameters to be confirmed by the Contractor – in Table 1. Offered storage units in item 1 from "Usable capacity" to "Rated capacity"; • Attachment No. 1A – Minimum equipment parameters to be confirmed by the Contractor – in Table 3. Offered MV/LV power transformers in item 1 from "Transformer power: up to 4.5 MVA" to "Transformer power: up to 4.5 MVA or higher provided that other requirements specified in the Request for Proposal documentation are met and it is demonstrated that the use of a higher transformer power does not negatively affect the parameters and safety of the installation operation"; • Attachment No. 2 – Functional-Utility Program – according to item XIV.3 of the Request for Proposal, the list of changes was published on the server containing documentation constituting a business secret and is available to Bidders who have submitted a signed Confidentiality Statement. Consequently, the Contracting Authority extended the deadline for submission of tenders to 28.10.2026.
UPDATE 05.10.2026 The Contracting Authority has made changes to: • Request for Proposal item VII.3. from "Planned contract signing date: 10/2026" to "Planned contract signing date: 11/2026"; • Attachment No. 1A – Minimum equipment parameters to be confirmed by the Contractor, document designation changed from "Attachment No. 1 to Request for Proposal No. 1/2026" to "Attachment No. 1A to Request for Proposal No. 1/2026"; • Attachment No. 1A – Minimum equipment parameters to be confirmed by the Contractor in Table 2. Terms of participation: - Knowledge and experience: The bidder may participate if they have the necessary knowledge and experience to carry out the order, including over the last 5 years or a shorter period if their business activity period is shorter: a) properly performed at least 4 EPC contracts with a total value of at least PLN 10,000,000.00 (in words: ten million zlotys) net, within which installations with energy storage were built, including at least one contract worth at least PLN 6,000,000.00 (in words: six million zlotys) net, within which: - container energy storage with a minimum power of 0.5 MW and minimum capacity of 2 MWh equipped with an electric energy management system was made, AND - the telemechanics project was executed and agreed with the DSO, AND - participated in the process of obtaining an occupancy permit and a license for storage and delivery of electric energy to the distribution network granted by the President of the Energy Regulatory Office
or properly performed at least 3 EPC contracts with a total value of at least PLN 25,000,000.00 (in words: twenty-five million zlotys) net, within which installations with energy generation modules were built, including at least one contract worth at least PLN 10,000,000.00 (in words: ten million zlotys) net, within which: - integration with the plant network at an operational industrial or production plant was made, AND - modernization or replacement of MV switchgear, busbars, LV switchgear along with commissioning was made, AND - the telemechanics project was executed and agreed with the DSO.
b) properly performed at least 1 EPC contract worth at least PLN 5,000,000.00 (in words: five million zlotys) net, within which construction works in the structural-construction industry were performed; c) provided at least 1 service and warranty service for an energy storage with power no less than 0.5 MW and capacity no less than 2 MWh for at least 12 months.
The conditions specified in points a), b) and c) must be met collectively.
NOTE: For the purposes of this proceeding, the execution of an order in the EPC (Engineering, Procurement, Construction) formula means comprehensive investment implementation by one entity, including at least: - delivery and/or procurement of devices and materials, - execution of works and/or assembly, - commissioning and/or start-up, - testing, - handover for operation, with the Contractor simultaneously bearing full contractual responsibility for performance of the above scope (including subcontractors, if engaged).
NOTE: If a value is provided in a currency other than PLN, it will be converted to PLN at the average exchange rate of that currency published by the National Bank of Poland on the announcement date of the request for proposal.
Method of verification of the condition: Verification will be carried out based on: • bidder's statement on meeting the participation conditions, included in Attachment No. 1 to this request for proposal – Offer Form, • list of completed contracts according to the template specified in Attachment No. 1 to this request for proposal – Offer Form, • evidence confirming proper execution of contracts and services indicated in the above list: final acceptance protocols, references, declarations with a copy of the invoice or other documents confirming proper fulfillment of the order issued by the entity for whom the order was performed, unequivocally confirming the order scope, execution period, and entity for whom it was performed. - Technical potential: The bidder may participate if they have appropriate technical resources, infrastructure, and certification enabling proper execution of the subject matter, including implemented and maintained systems in accordance with the following standards: a) quality management compliant with ISO 9001 or equivalent, b) environmental management compliant with ISO 14001 or equivalent, c) information security compliant with ISO 27001 or equivalent. Method of evaluating the condition: Verification will be based on: • an Offeror's statement on meeting the conditions for participation in the procedure, included in Annex No. 1 to the inquiry – Offer Form, • current (valid on the day of the deadline for submitting offers) certificates issued by an independent, accredited certification body confirming the operation of the required systems. - Persons capable of executing the order: An Offeror who, as of the date of signing the Contract, has or will have a team possessing the rights, qualifications, and experience necessary for the proper execution of the subject of the order and who will be assigned to carry out the order may apply for the order. The team must consist at least of: • construction manager, possessing collectively: building permits to manage construction works without restrictions in the structural and construction specialty; at least 2 years of experience in managing construction works as a construction manager or site manager, counted from the date of obtaining the rights mentioned above; current (for the given year) certificate of membership in the relevant District Chamber of Civil Engineers; current civil liability insurance (OC) required for persons performing independent technical functions in construction.

• specialist in electric power project implementation, possessing collectively: experience in implementation of electric power investments including MV/LV networks, transformer stations, inverters or switchgear – this condition will be considered fulfilled if the indicated person participated in the implementation of at least 1 electric power investment within the last 5 years before the offer submission deadline; experience in energy storage technology (LFP) – this condition will be considered fulfilled if the indicated person participated in the implementation of at least 1 investment involving electrical energy storage within the last 5 years before the offer submission deadline; knowledge of construction and energy regulations – this condition will be considered fulfilled if the indicated person participated in the implementation of at least 1 investment requiring the preparation of design documentation, obtaining administrative decisions, or conducting investment acceptances within the last 5 years before the offer submission deadline; experience in managing technical and formal risk – this condition will be considered fulfilled if the indicated person participated in the implementation of at least 1 investment involving obtaining decisions on development conditions, building permits, branch agreements, or investment acceptances (WZ, PB, building permit, acceptances) within the last 5 years before the offer submission deadline.
Method of evaluating the condition: Verification will be based on the Offeror's statement on meeting the conditions for participation, included in Annex No. 1 to the inquiry – Offer Form. - Economic and financial situation: An Offeror who is in an economic and financial situation enabling proper execution of the order may apply for the order, including: a) having financial resources or creditworthiness totaling at least PLN 15,000,000.00 (in words: fifteen million zlotys), b) reported net sales revenues of at least PLN 70,000,000.00 (in words: seventy million zlotys) for the last financial year, c) not being overdue in paying taxes or social and health insurance contributions, d) having civil liability insurance regarding conducted activities related to the order subject matter for at least PLN 30,000,000.00 (in words: thirty million zlotys).
Method of evaluating the condition: Verification will be based on: • an Offeror's statement on meeting the conditions for participation, included in Annex No. 1 to the inquiry – Offer Form, • bank or credit union certificate confirming the amount of held funds and/or creditworthiness, issued no earlier than 3 months before the offer submission deadline, • part of the financial statement (profit and loss account), and for entities not obliged to prepare it – other financial document(s) confirming the amount of revenues for the indicated period (e.g., appropriate PIT declaration with UPO), • certificate issued no earlier than 3 months before the offer deadline from the Tax Office and Social Insurance Institution or equivalent documents issued by competent authorities in the country where the Offeror is based or resident, confirming no arrears in taxes, fees, or social and health insurance contributions. If such documents are not issued in a given country, a relevant statement in this regard may be submitted. • a copy of the insurance policy or other document confirming civil liability insurance with confirmation of premium payment (if required). If the paid insurance period expires during the period the Offeror is bound to the submitted offer, the Offeror must additionally declare that the insurance will be extended on at least the conditions required by the Inquiry.
NOTE: If the value is given in a currency other than PLN, the amount will be converted to PLN at the average exchange rate of the currency published by the National Bank of Poland on the day the inquiry is announced. - Additional participation conditions: => Entities personally or financially related to the Contracting Authority are excluded from participation. Personal or financial relations mean mutual relations between the Contracting Authority or persons authorized to incur obligations on behalf of the Contracting Authority, or persons performing activities related to the preparation and conducting of the Contractor selection procedure on behalf of the Contracting Authority, and the Offeror, particularly involving: a) participation in a company as a partner in a civil law partnership or personal partnership, b) holding at least 10% share or stock, unless a lower threshold results from law provisions or is specified in other documents related to the project, c) holding a function of a supervisory or managing body member, proxy, attorney, d) being in marriage, direct line kinship or affinity, kinship or affinity to the second degree in the collateral line, or related by adoption, care, or guardianship, or cohabiting with the Contractor, legal substitute, or members of managing or supervisory bodies of contractors applying for the order, e) having such legal or factual relationship with the Contracting Authority that there is justified doubt about their impartiality or independence concerning the procurement procedure.
Method of verifying grounds/lack of grounds for exclusion: Verification will be based on the Offeror’s statement on meeting the conditions for participation included in Annex No. 1 to the inquiry – Offer Form and statements of the Contracting Authority and persons performing activities related to the preparation and conducting of the Contractor selection procedure on behalf of the Contracting Authority.

An Offeror based or residing outside the territory of the Republic of Poland submits a document or documents issued in the country where it is based or resides.
