The subject of the order is carried out within the framework of a targeted grant provided by the Voivode of Łódzkie to the Radomsko County, intended for financing own tasks implemented under the OLiOC program, whose implementer is a local government unit and/or another implementer designated by the local government unit.1. The subject of the order is: Purchase, installation, and integration into the network of an energy storage facility. The contractor shall undertake the design, delivery, and execution together with the commissioning of an energy storage integrated with the Ordering Party’s energy installation, including existing RES, in accordance with the requirements specified in the Terms of Reference (hereinafter SWZ), particularly the Description of the Subject of the Order contained in the SWZ.2. The subject of the order is described by means of project documentation, which includes:1) Technical specification for the execution and receipt of works – Annex No. 7 to SWZ 2) CONSTRUCTION PROJECT Construction of a photovoltaic installation with a power up to 1 MW as part of the task "PV Installations and Energy Storage for the District Hospital in Radomsko" – Annex No. 10 to SWZ VOLUME I Land development project VOLUME II Architectural and construction project VOLUME III Attachments of the construction project 3) Decision No. 625/2025 dated October 28, 2025, permitting the construction of 6 modular roofs and a photovoltaic installation with a power up to 1 MW as part of the task ‘PV installation and energy storage for the District Hospital in Radomsko - Annex No. 11 SWZ 3. The detailed scope of work and responsibilities of the contractor is specified in Annex No. 2 to SWZ – project contract.4. Justification for non-division of the order into parts: The subject of the order is the delivery of an energy storage facility, and the execution of this delivery must be preceded by the introduction of changes to the project documentation owned by the Ordering Party and obtaining a decision amending the existing building permit to ensure that this documentation corresponds to the energy storage offered by the contractor and the description contained in the description of the subject of the order (OPZ) prepared by the Ordering Party. This necessitates the commissioning of auxiliary – design tasks to the contractor of the energy storage delivery task. The occurring construction works are also merely auxiliary, related to specific equipment to be delivered by the energy storage supplier, and they do not have an independent character. Additionally, the Ordering Party has a single deadline for the entire task, which also justifies commissioning the entire order to one contractor. Obtaining a single quality guarantee for the entire task strengthens the protection of the Ordering Party.5. All requirements specified in the aforementioned documents constitute minimum requirements and their fulfillment is obligatory. Failure to meet these minimum requirements will result in the rejection of the offer as non-compliant with the terms of the contract based on art. 226 para. 1 item 5 of the Public Procurement Law.7. In the event that, whenever documentation refers to the names of construction products, materials, and devices or any formulations that may indicate a specific manufacturer, it should be taken into account that they were used as examples for the purpose of the documentation development. Parameter values in the documentation should be treated as the minimum required by the Ordering Party. They indicate the minimum quality of the product, durability, safety, physical characteristics, and functional parameters, and are not absolutely mandatory (equivalent solutions described in Annex No. 7 to SWZ – technical specification are allowed). Equivalent solutions should not be worse than those specified in the project documentation. The proposition of equivalent solutions is allowed provided that they guarantee obtaining overall user and functionality parameters for the subject of the order that are not worse than those assumed in the project and technical documentation, meaning achieving the same or better values.
